    Phillips & Cohen Associates?

    Has anybody heard of them? They've started collection efforts on one of my debts. I looked them up on the web, and from what I can tell on there, I had better never answer any phone calls from them. I try to never answer the phone anyways, unless it's a local call, or a call from someone I know. But anyways, I heard that they routinely violate the FDCPA, and FCRA, too. I heard they even threaten to throw debtors in jail for not paying, which is simply a lie, but it would be enough to get me to start cussing at them, and I've heard that it is illegal to cuss at people over the telephone. So, it's best to just never talk to them on the phone. Sometimes, it's so tempting the pick up the phone and start screaming at them, when I know it's a call from a debt collector.
    The world's simplest C & D Letter:
    "I demand that you cease and desist from any communication with me."
    Notice that I never actually mention or acknowledge the debt in my letter.

    Answer the phone and record everything. Let them violate the law. Of course let them know you are recording it. This will force them to be nice They will either be nice to the tape recorder or be nasty and you can sue them and you will have the evidence.

      If you are going to record the phone conversation check your states wiretap laws. The state I live in allows you to record a telephone conversation as long as one of the parties has knowledge of it. That party would be you.

        In Florida, both parties must know and approve a telephone recording.

        In Florida, if you record a telephone conversation without getting the other party's consent, not only is the recording inadmissible, but you are committing a crime.
