    TD Auto Finance question

My God-daughter is co-signer to a car loan for about 10K on a vehicle that both she and her ex bought together. The ex has been gone for about six months, and has the vehicle. Now DGD has gotten a 'nice, friendly' "we understand bad things happen, but your car payment is more than thirty days past due" notice.

If anyone has experience with TD Auto Finance, how far past due does the payments have to be to trigger such a notice?

DGD has had no contact with her ex, and does not want any. Nor do we, as the ex is extremely violent. DGD does not want to have to file BK to be rid of this, as she has an extremely good credit rating and has been years rebuilding it from a prior bankruptcy.

    Thanks.

TD Auto Finance is the former Chrysler credit program. My current car loan is with them. As with any car loan, as soon as your payment is not received by the due date, a notice is sent or a phone call made that the payment is late (friendly reminder). So this car loan can be a few days late to several days late. "Late" is any time after the due date of the last payment due.

Sounds like it's time to contact an attorney for some advice if she has nothing to do with this person and he has the vehicle and her name is on the loan. Is her name on the title?

Hi Flamingo; nice to see you!

Unfortunately, yes, her name is on the title. What we don't know, and DGD doesn't remember, is whether it is an "And" statement, or an "Or" Statement. She doesn't have any of the paperwork--the ex has that. She is going to contact TD tomorrow about it.

Not sure about her state but here in AZ you can go on the MVD website and do a title lookup (if you are on the title) which will tell you if it is And or Or
