    Neighbor called the fire Dept!

My ex-neighbor called the fire Dept about our backyard on our yet to be foreclosed house and told the fire dept. it is a fire hazard.

(we don't live there anymore) - Can they fine me/bill me?

    What should I do?

***I do want to clean it up but everyone I know (except for my Neighbors) is telling me to FORGET ABOUT IT....

The backyard is like a jungle. We just got a CH7 discharge a few weeks ago (and the house was included in the BK) but the bank has yet to even start the foreclosure process.

Some weeds are over 6 feet tall! And the bank has like 4 more months to foreclose!.

    thanks, techno

Your neighbor is not a fine fellow is he? Personally, I would drop him a note giving him permission to clean it up himself or address the person who now owns the house. (Not telling him details). If you are forfieting the house, the deal is done isn't it? Surely they know you bked? 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

They have not foreclosed yet - And I am sure the house is still in our names....

We did a BK7 and included the house in the BK but according to our attorney, the bank still has to "foreclose" on the house until it's "technically" out of our name.... (which would be in about 4 months)....

      thanks, techno

Clean it up. If I was your neighbor, I'd be livid. It's not just a fire hazard, it's a health hazard. Rats, snakes, etc. could be living in that mess.

I lived through this once. I was renting a house and my neighbor (who was a young, healthy, guy) decided he didn't like yard work and so he just didn't do it. The front and back yards both grew several feet high, and yes there was all kinds of little creatures living in it. Yuck. Thankfully my city had an ordinance not allowing this and so they finally came out and cut it all down and then sent him a bill. You very well could be issued a bill too.

I agree, besides, if you still technically own this house, then if the city has to clean it, can't they hold you responsible for the bill? I know where I live, if the city has to come in and clean up the property, then the home owner, which is you now, is responsible for the bill.

I think, it would be worth taking care of this for now. Then keep it trimmed up until the bank takes it.

I agree, you should have the yard kept up. If you have any good neighbors, maybe they'll be willing to go over there and mow once a week or when it needs it. If the city has to do it, they will add the costs to the property taxes as a special assessment, which will have to be resolved when the bank takes possession of the home and most likely, the bank or new owner will have to pay this. I highly doubt that you would receive a bill for the charges. In any case, I would clean up the yard if you can.

How hard it is to clean up?... just take a lawn mower... and exercise your body too.

If not, offer that neighbor $30-50 per week to mow.

It actually would be better for all concerned to make some kind of arrangment to get it cleaned up. If a house *looks* vacant, then it is inviting break-ins and possibly worse troubles.

I cleaned up! Took 7 hours to do the backyard.

I just finished cleaning the backyard up - started at 7am and went to about 2pm about 10 bags of trash.

Went over the neigbor (the one who called the fire dept.) after I cleaned up
and told him I was very sorry for the non-upkeep of the house for the last 6 months and that I have been through a really bad time. (turns out he is an ex-fire fighter)

I then gave him my phone # and told him to call me anytime if the yard gets bad or for whatever reason.... I told him to look over the fence and he was happy with the clean-up.

I think he appreciated it! I cannot blame him for calling the fire dept as it was pretty bad and CA is very very dry right now.....

Wonder if I will get a warning or something from the city?
I never heard from the city --- I did take before and after pics though just in case....

Thanks guys for all your comments!

I felt really bad about the house and how I did not keep it up for the last 6 months and was extremely embarrassed to go back into the niehgborhood
as it's pretty obvious that I am losing the house....I guess the whole thing has been an embarrasment and I didnt want to deal with the house....

now I feel a little better!

Now I have to do the front yard......

Good for you technoreid1. I know it must have been difficult to go back there. Hopefully, the neighbor will get in touch with you if there's an issue. I wouldn't worry about the city now. The yard is cleaned up.

I hope this ends for you soon and you can move on.

                        Yippee Techno!!!

You did Great. You probably will not get a citation or anything else from the city. This depends on if there was a Code Violation and how long it has occurred before it will trigger a report. Typically, at least here in Florida it takes 3 months of violations before Codes gets involved. Of course, if you have an Adversary--@#$%^&*#@--like we have, that Creature will have turned in an Anonymous Complaint to the Codes authorities, and your problems will have only begun.

Your neighbor that called the Fire Department, actually did you a favor.

Good for you, you did the right thing and don't you feel better for it? In this economy don't be embarrassed, you made your neighbors happy and did a good thing. You may have prevented a fire hazard for those people who live by your home, and that should give you peace of mind. You will find that taking care of the property, even though it won't be yours forever will make you healthier and happier!!!

I think the city won't do a thing to you now, just keep up the good work, they can't fine you for a job well done. Just stop by once in awhile and make sure everything looks good, remember technically right now that house is in your name and your responsible for it.

Good job!! As hard as it was to go back, and I do know how that feels, it will all be over soon enough. Just hold you head up, you did a good thing!

Yea - it was super embarrassing going back to that "old" house.....

I felt like the neighbors were going to flatten my tire or yell at me for not
keeping the house up.... I felt like I abandoned the house (which I basically did) - kind of sad going back to a house that was once in decent shape and then seeing the lawn that has turned to hay.....

I am sure it pisses them off as it would myself if a house next to me was not "kept up"......

I am in Northern CA and the sky is fairly hazy 24 hours a day- pretty bad..... I think there are about 1,000 fires now. It's weird looking up into the sky and it's all bleek....
