That's too bad, you could have lived there free for quite a while.
Just call them when you vacate, they will come out and change the locks.
Unfortunately, you won't be able to cancel the insurance until the day of sale.
I wished they were 'backed up' in TX, I am scheduled for Sale December 2nd. 5 months from the time I stopped paying.
And the bank seemed surprised I didn't want a 'workout'...
After I tried on 2 different occassions??? Meh...

My sale is scheduled for Nov. 18th. I've talked to people who've had 3 auction/sales before the lender contacts them about moving out. Seems to be a little different in each state and with each lender, which is the worst part for me, dealing with the unknown timeline.Originally posted by BK2008 View PostThat's too bad, you could have lived there free for quite a while.

FWIW, my homeowner's insurance cancelled for lack of payment, and I got a letter from the lender saying that if i didn't keep the insurance current, they would cover the premium and add that amount onto the mortgage balance.
Ummmm...OK by me

That's the hardest part of losing my house...this has always been "sanctuary" for the little ones.

I dont understand....so if you havent kept up homeowners insurance, the mortgage co will pay it and justa dd it onto loan....In my case, I am surrendering home, so they can do what they want with the loan right?Originally posted by No Gravy View Post

if I am eventually going to be foreclosed on (missed pmts in feb/mar/apr and filing ch 7 in july) while I live here for free do i have to pay homeowners?
waiting to file in july-august,
waiting for Chase to begin foreclosure,
waiting for cc's to begin lawsuits,
just waiting (& "afraid")...

The danger of not paying your homeowner's insurance while the home is still in your name is that if anyone has an accident on your property, you will still be held legally liable, even if you have already surrendered the home when you filed bankruptcy. If you have no homeowner's insurance, then you get to pay for their accident in full out of your own pocket. It's no way to get a clean slate financial start after filing.Originally posted by AfraidOfBK View Postif I am eventually going to be foreclosed on (missed pmts in feb/mar/apr and filing ch 7 in july) while I live here for free do i have to pay homeowners?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Standard disclaimer about how each case if different, and you should really consult a BK attorney about such an important financial and legal decision...Originally posted by AfraidOfBK View PostI dont understand....so if you havent kept up homeowners insurance, the mortgage co will pay it and justa dd it onto loan....In my case, I am surrendering home, so they can do what they want with the loan right?

but I was advised not to pay anything related to the house, after it was obvious that I would lose it and file BK. It does depend on how quickly you expect to file BK, also. I've seen law suits over past due HOI come up a lot faster than foreclosures.
