    Surrendered home, still waiting!

    I decided to surrender my home last dec and here it is feb and my case has since been discharged. I still have not heard one peep out of anyone in regards to my house? Doesn't the mortgage company have to follow a forclosure timeline even if I surrendered it? I know someone mentioned they can have things rushed along, but don't I still need to get some kind of notification to vacate?

    Anyhow I have it empty and cleaned up, I have only a bike rack system thing to take down in the garage. So I am stopping by to get that today, so it doesn't matter at this point. (we moved out at christmas) But I really and kind of curious as why I have yet to hear anything, and if I ever will?

    I was over there yesterday and noticed that someone had been in the backyard and walked around it in a weird pattern. It was kind of creepy as I have a 6 foot privacy fence and the foot prints were a mans for sure. It snowed only a few days before so it had to of been in the last week... Do they send someone out to sneak about the property for anything?

    It's not uncommon to not hear anything from your lender regarding the foreclosure for quite some time. Lenders are swamped with foreclosures these days so it could take up to a year or longer for them to finally finish the foreclosure. There's no "etched-in-stone" timeline they are to follow. The timeslines you might find on the web or what you read around here may not be real numbers, especially with the problems in our current economic situation. Anyways, what you will start to recieve by certified mail is the case against you regarding the foreclosure of the home. These will be official court documents. Since you surrendered the home, you don't need to repsond or show up to the dates mentioned, but keep these documents in a safe place for a while.

    The footprints in the yard could have been an appraiser (for the Sheriff's sale) or someone who has access to pre-foreclosure listings checking out the house. I would inform the local police department about it though and tell them the home is empty and you've been informed that people have been lurking in the yard..........they'll keep an eye on it and watch for suspicious behavior.

    Don't be surprised if this takes up to a year or longer. Our foreclosure took about 20 months after we were in default (we were in default in Spet.05 and the deed was transfered in May, 07).

      Mine is going on 18 months and just the NOD. Still no peep from CW.

        Thanks for the information, I really hope it doesn't take that long. I hurried my family out of the house so we wouldn't get a suprise and be in a rush, now I am thinking it was stupid to have been worried. But oh well at least now we don't have to deal with a sudden move out. It sucks though as HOA fees will start adding up, and I don't like leaving it abandoned for so long. Lets say I turn off all the utilities and lock her up. And a few months go by and someone breaks in and destroys the place, is it my fault?

        I know my home owners was paid for the year back in sep.

          Finally got a notice, Citimortgage told me I had until March 15th to send payment to bring my account current or they may start the forclosure process....

          Anyhow, I finally got my water turned off and gas will be disconnected later in the week so I can shut down the house. I have a few questions though, as march comes on so does grass season. Will I get in trouble for not taking care of the property now that it has been surrendered? I really do not want to deal with going over there and doing all that with my nosey neighbors watching. Secondly I called citimortgage when told and noted to them I abondoned the property, but they didn't seem to care. They still are trying to get me to pay them money! Am I still responsible for anything happening to the home?
