    Need help with letter received today

    Ok so I filed Ch 7 last month. Right before I filed I was in the middle of a mod with my mortgage co. I received a letter a few weeks ago stating my mod was denied and someone from WF would be contacting me to discuss other options. Well I never received any other contact from WF.

    Today I received a letter stating:

    That they are writing to confirm that after being offered the opportunity to take part in the federal government's Home Affordable Foreclosure Alternatives (HAFA) program, you did not respond within 14 days of the program intro letter. Therefore, the request under HAFA has been withdrawn.

    Then it lists some other info that might be available to me like: deed in lieu, short sale, ect...

    The letter also states that this an attempt to collect a debt..blah blah blah.

    So what is this letter??? I haven't received anything else from WF.

    Any advice??

      Freddy I'm at a loss on this one. It sounds as if since you allegedly have not contacted WF for the HAFA, they sold your mortgage to a collector. Anytime you see the words "this is an attempt to collect" that is what they are doing. A CA has your mortgage. 'Hub

        wells fargo and the other banks seems to be doing this type of thing more and more.

        i know you want to stay there as long as possible ...chase did the exact same thing to us and we were actually IN LOAN MOD when we rec'd our foreclosure summons. so one hand doesn't know what the other is doing in any of these banks anymore. wells fargo is ONE OF THE WORSE..actually, i have to go to calif next month really just to go into wells fargo with my mother to straighten out even the most "normal" of banking situations with them. i would just let your atty know they wells fargo is in violation of the stay, since you just had your 341 ....was your stay lifted???????

        they have no right to attempt to do anything unless the stay was lifted. i'm go right after their butts real fast!

          My attorney has not said anything about the stay being lifted. I'm waiting for his call back today about the garnishment so I'll ask about that.

          The only other paper I received since filing was a letter stating the mod was denied and someone would be contacting me about other possibilities. They never called.

            well then freddy...

            that's a BIG NO NO when you're in bk and they are in fact in violation of the stay, those so and so's!!!! i really would go get them and insist your atty notify the court that wells fargo is in violation of the stay. (i HATE THEM!) and not for the reasons most people do.

            make a long story really really short...i have the POA and DPOA for my mom who is 93, wells fargo says they will not recognize anything other then their OWN made-up policies. they are in fact above the probate laws of the land, or so they say.

            so of course what would make them think they are above the federal bk laws????? nothing, and there is no one to enforce these things. however, in your case, they are clearly in violation of the stay by attempting to collect a debt.

            go get them for everyone..LOL!!! (like you need another fight on your hands NOT!).

              I have to fax my attorney the letter and he will contact them. Well see what happens....

              Fingers crossed that this FC process is very long.

                good! and from what you have been saying your mortgage was not sent to a collection agency????? i mean prior to filing, other wise i know you, and you would have most certainly listed them. so i think it's wells fargo, just being...well......WELL FARGO.
