    Inheritance within 180 days post file Chapter 7

    Hi,
    I am set to receive an inheritance that is more than my debt in a Ch 7 case, so now all of my debt will be paid off. The heir passed after Ch 7 closing and before the 180 day rule. Can anyone share how long it took to receive any surplus amount and what the fees paid to the Trustee are? I am in CA and will be receiving a good amount asap due to the wildcard exemption. There is another month for creditors to file claims, all c.c. debt, so far 4/7 have filed. Thank you

    I'm sorry for your loss. I'm also sorry to tell you that there is no way anyone can tell you how long it will take. The Trustee may have a general idea, but distributions take time. The Trustee has to send out a notice that the case is now an asset case. They then have to set a date to file claims, which is 90 days and governmental units (think IRS) get 180 days. They then have to wait for the claims. They then have to pay the claims once they are approved. They then have to wait 30-45 days to see if all the checks clear. They then will issue a final report and send the residual to you.

    It looks like you know that there is another 30 days to file claims. I don't know if your Trustee will wait for governmental claims.
