    We have a family plan for 3 phones with Tmobile
    2 are financed and 1 we bought used and own for our son.
    my question is can we remove the used phone from the plan before filing bankruptcy and then be able to use it on another prepaid plan with Tmobile after bankruptcy?

    You should be able to move that paid phone to another plan. For what it's worth, the cellular companies are usually pretty easy to deal with in bankruptcy. I don't know if your current account is a prepaid plan but the bankruptcy shouldn't affect a prepaid plan because you pay in advance. As for the financed phones I can't tell you whether TMobile will treat them as "secured" debt meaning you have to pay for them.

      We would like to keep our phones and plan if we are allowed to. We will most likely be filing a chapter 13.
