I wonder how long I could have gone without a word from MBNA, had I not initiated contact with the collection agency in an attempt to work out a payment plan. It's a moot point, tho, since they're now on my list.

...got nothing from them from 2001 to 2003...then I got weird letters & decided to do an offer/compromise..way before I realized I would be filing & stupidly paid them $4,500 which I am now getting taxed on and have to deal with.....I am getting fined for paying a debt!?!

I should have never paid a thing...I had a $5K debt with BOA and did pay the whole thing off...since it was my bank and I didn't want any problems there...

I am sure they run an asset search, and conclude that it is not worth throwing good money after bad money. They might have concluded that they would just be wasting their money to push you to file, and they would just end up deeper in the hole.

We owe them the most money~ and I am thinking they are waiting around the corner......
I can't believe that they would not come after you with some type of formal suit.........
Never heard from them after they made an offer to settle for 75 cents on the dollar.

A different cc filed and has a judgement against me, after 6-7 month of defaulting. I have nothing they can seize or garnish. A few month ago, I got a letter from their lawyers, saying to the effect that at this point they are not making constructive effort to collect. In other words, 'we know you have got squat that we can collect from, but we are not giving up." Legalese to preserve their rights. blahblahblah.

Truth be told, they can all go and get a judgement against me, and nothing would come of it. Judgement proof in America.

But if I make a come back, I am sure the wolves would be circling.

I am working to wipe the slate clean tho.

When BK is filed, is the notice served to the one who bought the debt or the original creditor, or both? If the debt has been sold a couple times, does each of the buyer have to be served?

We had an MBNA acct. Got notice some time back that BoA had bought out MBNA.

Now the MBNA acct shows on our Credit Reports as BoA MBNA.

I had checking account with Bank One for years (10 or so...) and then moved to california where there is no Bank One. I didn't have any credit cards with Bank One at all. I filed BK back in October 2005. Somewhere along the way (not sure when), Chase bought out Bank One. I wasn't even aware of this. Well I kinda forgot about the Bank One account until recently. So I called Bank One to see what I needed to do to get my $100.00. First of all when I called the 800# for bank one they answered "Chase customer service". So when I gave them the account # they transferred me to the deliquient accounts department who explained to me that they account had been taken for payment of a deliquent credit card account when my bankruptcy was filed. She gave me the credit card account number and it matched my chase account. So thats my story. I'm out a $100.00, but in the whole scheme of things its not that big of a deal. I'm just happy to be done with the whole BK thing! My suggestion is open an account with a local bank or credit union before filing and you are much safer from buyouts and changes of ownership.
