    Creditor Harrassing My Parents Now

    I just had my mother call me with a very nasty phone message from this MRS Associates that had called them last week.

    My bankruptcy will be filed in the next 2 months or so, but until then...is sending them a certified letter going to stop these calls? Will that do it? I have no bankruptcy on file, so I'm lost as to what to do.

    My parents are in their 60's and do NOT need my aggravation....any advice?

    I am assuming that MRS Associates are not the orignal creditor? First things first, tell your parents should they call again, to tell them firmly that they (your parents) no longer want them to call that number, if they call it again they (your parents) will report them to the Federal Trade Commission for violation of the Fair Debt Collections Pratices Act. You need to send them a Cease and Desist letter, make a copy of this letter for yourself and be sure to send it return receipt requested, so you know they have received it. Be sure to tell them in this letter that anything needing to be said to you needs to be done in writing(provide your address). Should they continue with the violations of the FDCPA go here http://www.ftc.gov/ click on "file a complaint" at the top and report them.

    If in fact they are the original creditor, the cease and desist letter will not apply to them.

      Hi BK...they are a collection agency. I have 5 credit cards and I have no idea which one they are asking about, for they are being nice enough they aren't telling my parents which one, which is very surprising. I've got a call into my attorney to call me back about writing this letter - I really want to call this woman up and let her have it for her tone - this message was so hateful and my mom is scared to death, thinking I'm going to get in some serious trouble.

      I want to let him know what I'm doing, give him a copy of the letter and take it from there. He specializes in bankruptcy,but I don't believe there's much more I can do besides the letter at this point. I'm SO close to calling this woman..but I do believe I have to in order to find out what account she is talking about. Get it in writing from her, copies of the bill, and their letterhead for her correct name and address.

      I should think I'd need to know all this to send a cease and desist letter, eh?

        Saw this notice on their webpage:
        "MRS ASSOCIATES is proud to announce a new address and expanded facilities for our North New Jersey Call Center: PARSIPPANY, NJ 07054, 1- 800-470-6622" I'm betting your nasty collector call originated from here.

        Promise me one thing - you will talk to your lawyer before you do anything. Trust me - calling the person who left the message is just a waste of your time and opens you up to the potential of saying something by accident that will help them harass you even more. To the collector who left that message, it's just a job. They are trained to not care and to say anything necessary within the law (and sometimes outside it if they think they can get away with it) to get you to pay, period. Nothing is sacred. Tell your mom not to worry - they can do nothing to you after you file, no matter what they threaten now.

          My attorney told me to direct them to her. All phone calls have stopped. No more letters either. Is your attorney willing to do that with you??
