Once an attorney has been retained ($200 fee), do creditors have to stop contacting you personally? My attorney says to refer calls to them...the filing won't take place til october..what can the cc companies do in that timeframe?

Your creditors won't stop contacting you until your bankruptcy case is filed with the courts - that's when the automatic stay goes into effect and they aren't allowed to contact you. You can refer the calls to your attorney's office and that will reduce the calls for awhile until they don't receive a case number - then they start calling again. There are some excellent posts and stickys here in the forum explaining the best ways to deal with creditor calls - well worth reading in your situation.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

I think it depends on the creditor. I only have 2 out of 15 that call me regularly, maybe every other day. Once I gave them all my attorney's name and phone number the calls pretty much stopped.Petition Filed 6/4/07 :clapping:

We hired our attny and started giving every one of our Creditors his contact info. The calls stopped. But then our filing got delayed because we needed to move. A couple months later, the calls started back up.
One Lady even asked if we were still gonna file. I said "Yes". She said, "You better tell your attny to get his butt in gear and get your case filed."

We didn't file for another 4 months. Nothing happened.
Pick your attny. Get your docs gathered and turned in. Keep updating as needed. Tell your Creditors if you want. Wait as long as you need and file when you want to. Not before. Unless something happens that forces your hand. Then you're ready to go on a moment's notice.Filed Ch 7 - 09/06

Wow,when i retained my attorney,it seemed like forever to finally pay in full.
So many calls at work,i tried send them to my attorneys to handle.But they just said no need to talk to them.they would even let give them attorney names.then one on my cellphone i put in my greeting if you are calling about a bill please call ___-____. It seemed to stop or slow down calls.well now the Ch.7 has been filed,finally. the calls finally have stopped.CH. 7 Filed 4/4/07 done
