    I answered the phone today...

    Yesterday I met with our attorney's paralegal to start putting the bankruptcy info together. It ended up that she and I used to work together years ago. She was so wonderful to me... oh my, I can't tell you how relieved I feel having someone I feel so comfortable with handling things (I really like our attorney, too). She really knows her stuff too. I was a nervous wreck heading into the meeting as dh may need to go back into the hospital and I have been battling with my dd's school over their response to racial taunts she has been receiving and working on mending her broken heart. So my weary self was so relieved at how well the meeting yesterday went.

    She told me that we could refer all calls to them now. Yesterday I was too afraid to answer the phone still. Today, I gathered up my nerve and took two calls. I wanted to share that both of them were very nice to me. I told them we would soon be filing and they asked for the attorney's name & number and said they would update their records. Two off the calling us list so far - hooray! It is quieter already, especially since Chase stopped calling earlier this week.

    A few things to share just to give an idea of how our trustee will look at things...

    1. He allows pet expenses. Hooray, since I have 4.
    2. He allows $125 per month entertainment expenses.
    3. He allows $50 per month per person clothing expense.
    4. He allows voluntary 401-K deductions.
    5. We will have to do more extensive listing of personal property than some
    here seem to have experienced.
    6. We had purchased a lawn mower last year under the 0% interest & no
    payments for a year thing with the year period ending next month. She
    said that if it is unsecured, it will likely be problematic as we haven't made'
    any payments on it yet. She said they really frown upon that. So, I'm not
    exactly sure what we will do about that yet. (That issue was the only
    concerning item she saw so far.)
    7. She said the 341 meetings generally last 20-30 minutes which seems like it
    may be a little longer than others have experienced.
    8. My children's savings bonds (in their own names) do not need to be
    included anywhere.

    Those were just a few things that I thought might be of interest to others. We still have to see how our home appraisal comes out to know if it will be a 7 or 13, but a 7 seems pretty likely at present as we expect it will be within the allowed equity.

    I filed in March, and although Pacer lists my trustee as having nothing further to say, I received a letter from the DOJ Bankruptcy Analyst, asking for the same things I brought with me - the same questions.

    This gave me a momentary fright, as I was expecting to be served with a different notice.

    I called the next morning, and made sure I did it like a doctor's call - no caffeine beforehand!

    It seems that Chapter 7's are being handled with more scrutiny than before October 2005. Big surprise, we knew that.

    I was able to reach the signatory on the letter (in the UST Office), and was relieved to know that it is routine since October 2005 that all Chapter 7 bankruptcies over "a certain amount" are now scrutinized in this way.

    I have to provide copies of pretty much the same docs I brought to the 341, with a bit more detail in some areas.

    I know my situation very well, and have spent a lot of time cogitating on it. The man was extremely friendly and helpful - so I'm back to making perfect copies! :^)

    A minor hurdle, compared to the last several years!

      It's great that your first contact with your lawyer's office was such a positive one for you! Thanks for sharing about what kinds of expenses and debt payment timing your district accepts - a good example of how different the cultures and practices between bk districts can be. I think that many people in the US think that all our laws are interpreted and enacted the same way everywhere - so not true!
