Couple of questions first.... Are there sufficient funds in your checking account to cover the $375, or do you know that this check is going to bounce? Do you have overdraft protection on your checking account that you are counting on to prevent the check from bouncing? When are you buying the ticket in relation to when you plan to file?Originally posted by notavictim View PostPrior to filing if I charge a $375 plant ticket against my checking account to go visit a friend are they going to freak?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

1st on the ticket - my tax refund was over $1000. I have not filed BK yet. I am told I need to spend the refund on home/household expenses. Since I am a part time father of 3 that should be easy. But I also live frugally - or let's say within my means. So yes, the plane ticket would be out of my cash funds.
I am planning to file next week - although I've been told it takes 2 weeks for the attys to do the paperwork. I also heard the last 6 months of stubs and bank statements ends on the day I came into the atty office.
My situation is slightly different from a lot of what I've read. I've had this lawyer on retainer for almost a year. He advised me not to pay any creditors because that is just throwing away money IHPO. But that has left me with extra cash that I have had to be very careful with how I spend for over a year. The hardest part and there was no way around this was going through the hard drinking recently divorced and bitter bachelor phase. Plentiful bar bills from that. Now done with that phase and cleaning up loose ends. Ready to file within this window of between 2 bonuses from work. Tricky - but I have to get 7 since it was my ex's debt shifted to me after the divorce.

Actually, it's pay stubs and bank statements up to the day your petition is actually filed with the Court.Originally posted by notavictim View Post

And how long it will take your attny to prepare your petition,........... Heaven's knows. Could be as quick as 1 day. Could be a week. Could take a month or so. Depends on who's actually entering the info. A paralegal, a secretary, or your attny. What type of software program the attny's office uses.Filed Ch 7 - 09/06

That's not true, we retained our attorney in February and we STILL haven't filed, just sent a SECOND version of our petition back to them, but I expect we'll be filing next week, at least I hope so, I'm sick of this stuff.Originally posted by notavictim View Post

As for the bank statements, they've been having us fax them to them each and every month as well as our checkstubs, she said that will stop once we ACTUALLY file.

I think there has been some confusion. Your first post stated that you were going to charge the ticket against your checking account, then in your next post I thought I understood you to say it was cash and your lawyer told you to spend your tax refund on household expenses. There is a difference.
It would probably all come down to your trustee and his/her opinion. The best thing to do would be ask your attorney. If your attorney told you to spend you tax refund on household expenses, then my guess is no, a plane ticket is not a household expense and it could cause a problem.chap 7 discharge 06/07
