    questions -

    if you file bankruptcy -

    can the courts take your 401K money?

    can they take your pension fund?

    do you have to report bonuses and tax refunds?

    aaarrggghhh - so many questions.

    i know the advice here is not legal advice. i'm just looking to see if anyone has had the same questions.

    401K accounts/retirement accounts are exempt. Don't touch it prior to filing to pay bills as we did my husband's. Big mistake.

    If you file a Chapter 13, you may or may not have to report bonuses and tax refunds during the course of your Plan. Some do; some don't. When/if you file, always ask your attorney what, if anything, needs to be done if you have a change in financial status (i.e., bonuses, raises, inheritances, lottery winnings, tax refunds, cut in work hours, loss of income, etc.). Someone with Chapter 7 experience can clue you in on what may or may not be involved with a tax refund around the time of filing a Chapter 7.
