    13 to 7 conversion

    well over month and half ago, contacted attorney (retained previously for 13) letting him know that after 21 13 payments, i have reached a point where do not have the 560 payment due to increased medical problems, eye surgery, dental makeover prescriptions etc, at that time he told me not to make any 13 payments, that was last monmth, have been trying to get update from him on my situation via telephone calls and e mails which up until today he never responded, his response today "341 hearing scheduled sometime in april" is this a proper response should he not be aware of the date

    Did your lawyer file an amended Ch 13 plan or did he file to convert your 13 to Ch 7?

    06/01/06 - Filed Ch 13
    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      i think he filed to convert from 13 to 7

        If you are on your second 341, then he probably filed to convert to a 7. Do you have PACER access?

        341 Meetings: 11/28/05, 3/20/06, 12/4/07 (3d time's a charm!)
        Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)

          I agree with that, if you have a 341 meeting again, it will be due to the conversion. Same basic questions and "why are you converting," my reason was I had quit one job.

            I was not even asked why I converted this last time. The Trustee was cool, and acknowledged that we got a raw deal in Hawaii from the trustee there and the attorney we hired. It was smooth sailing for us.

              thion i might be in that category of getting bad deal, 74, only income ss and small 400 pension, my payback was $560 monthly on annual income of under 30k unfortunately same attorney doing the conversion
