    Credit Reporting for Non-filing Spouse

    Does anyone know of there should be any mention of the Chapter 13 BK for my husband since he didn't file? We have three things owned jointly, all of which are current. I pulled my credit report and those three loans show in a 13 bk. I hope that this doesn't reflect on his report as well.

      Have him pull his reports and see.
      It should not show up since, he never filed bk.

        I'm scared to aks him. He will absolutly freak if it reflects negativly on his score.

          If those 3 accounts were not part of your Chapter 13 they should not be posting as involved in BK either in your CRAs or your husbands. You will need to dispute with the CRAs that those accounts were not included in your filing (same as to your husband) and you may need to provide proof along with your dispute. Although my husband and I filed jointly, we had the BK show up in accounts that we opened after our discharge even though that account was not around during our 13 and opened after our discharge. Sometimes when a certain bank or lender is involved in your BK, it leaks out to other noninvolved accounts to which that creditor/lender is linked and it will end up on credit reports. Just dispute.

            Falmingo,

            Even thought they are not listed as part of my plan, we still had to notify them and they filed claims. They show on 13datacenter but with no balance owed. Should I still be able to dispute it? Also, my mortgage is and loan is being serviced in the BK dept now.

                Maybe I am getting confused here but in your first posting, you indicate you filed BK, your husband did not BUT you state there are 3 joint accounts that were not listed as part of your plan but you had to list them and they filed claims. How did these accounts get listed on your BK if they were joint? Were they zero balance cards at the time of your filing? I am a bit lost here because if they were joint cards and somehow they got through your BK and your husband's names are on the cards, you might have a mess to clean up. Without knowing your full situation in filing and how joint cards got involved in your own BK, I don't know how to answer you as to your husband's situation and how to get that off his credit reports. If you post more information or if someone else knows your circumstances better and can help out, that would be the best.

                  We share two mortgages a first and a second and a car loan together. No credit cards. This is what I am wanting clarification on. On my credit report it shows IIB13. Should it show that on his as well?

                    I suggest you pull his credit reports and see what is there. I am still trying to figure out how three joint accounts were included in a BK filed under your name only. I am assuming they are being paid outside of your Plan and all information properly filed by your attorney. Since the accounts were part of your BK, there is a good chance they will show up as such on your hubby's credit reports if his name is on the account. I am not familiar with your filing and a bit confused by your postings in this thread as to this situation. I would have to take the time and go back and review your initial postings as to your BK but unfortunately I do not have time to do that...

                      Yes, all three of the joint accounts are being paid outside the plan. I am going to pull his credit report tomorrow. If they are reflecting as IIB, should that lower his credit score as well? I hope not.

                        The issue here is that although these accounts are being paid outside of your Plan, and you state they are in joint names, those accounts are considered to fall under your bankruptcy so the chances of the bankruptcy informatoin appearing on your spouses credit reports are very high as to all three accounts. You may have trouble disputing and getting that information off if that is the case even though you filed bankruptcy under your name only. You may have to dispute with both the CRA's and the lenders to get the information removed as to your non-filing husband and provide all sorts of proof that he did not file; what the problem will be is that the accounts are in joint names and you may have a rough time...maybe someone else on here has gone through something similar and can help you out more...hope things work out for both of you.
