    Question How does Bankruptcy affect Section 8 & HUD renting?

    I am living in Section 8 housing and am filing for bankruptcy. Will I loose my apt over this?

    I can not possibly see why. Are you behind in your apartment payments?

      No I pay my rent on time. But since most is paid by Section 8 & HUD I really need to know if banckruptcy will affect my eligability.

        Katie1, please read this link. This case is about a person that also had Sec 8 housing and the court found that the rental could not be terminated just because the debtor filed BK. However, in this specific instance the debtor had also failed to disclose income as she was required to disclose so the housing authority terminated her benefits. The key here is the simple filing of a BK does not trigger the default, and in fact it is specifically prohibited to terminate benefits based on a BK. But other violations do not prevent the termination. (That's what I understand from the link anyway). Here is the link for your review:
