    Quick Question..

    I filed on 12-31, I emailed my attorney over the holiday and asked her when I would see my final petition. She said I wouldn't see it until I meet the lawyer at the 341. I find that unacceptable, should I raise a stink about it or let it go for now?

    You should have been given a copy of the one you signed before it was filed. You had to sign it before it was filed. Did you request a copy at that time?

      They sent out a packet to me, with numbers that were all wrong, I sent in all my paystubs made my own changes on it, all the signature pages were by themselves, so there was none of the corrected stuff on it, so they filed and I have yet to see the actual numbers that they filed. Just the numbers that I had put in but I'm sure they made a few changes. So no, I didn't see the final petition before they filed.

        You have every right to have a copy of the Petition you signed and paid for. Call the attorney's assistant or paralegal and request a copy be sent to you via regular mail or sent via email. They should be able to scan a copy to you (PDF) and send via email.

          Alright so, Laura (my lawyer) emailed me over my final Petition and three things I wanted to see what your opinions of it is.

          Listed on my creditor matrix is a checking account advance that I have with US Bank, it's just 550 dollars, and once I get paid next Saturday, it's going to have a zero balance as when I get paid it gets paid in full. I use it from time to time and right now it's at it's full. I'm worried about them cancelling my account.

          Secondly, She has my total value of household goods valued at 1500, now that's a real low number anyway you slice it (not sure where she got that number but I definitely have more than that), but she's only exempted 429 dollars, I don't know if I"m out of exemptions and that's why or what the deal is with that.

          She did exempt my entire tax refund, so at least that's nice.

          Third, my disposable income was 7.01, but it's missing my association fees of 182.57 on my housing part. Probably an overcite but I talked to them about it several times before filing, think it's kinda stupid that I gotta pay to get it amended now.

          Any suggestions or comments are welcome, thank you.

            Alright, so now I'm kinda freaking out, at the end of the petition where presumption of abuse arises, it's marked no, but using IRS standards and what not it says I have 478 Disposable, but on the I & J it's 2.30. Can anyone tell me if my lawyer is trying to screw me into a ch13.

              Are you over the median? If not, I wouldn't worry about it. If you are under the median you passed the means test and you don't have to be concerned with the IRS numbers. I had the same freak out type of moment as my disposable on Schedule J was over $400, but my lawyer assured me that there was no abuse because I was under the median and in my area that was all they go by. It may be different in your area, but in the end I listened to my attorney and everything turned out fine. If you are over the median and your means test is showing you have that much disposable, then you may possibly have some issue I am afraid.
