    Question My situation: Lawyers fees, and Wash Mutual

    I will be filing for BK sometime in 2009. I intend on putting it off as long as possible. I was a gambler and am very much underemployed at this time.
    Also, I filed BK 8 years ago.

    Here are my current debts:

    BofA: 23k
    Wash Mutual card #1: 10k
    Wash Mutual Card #2: 5.5K
    Juniper Barclays: 10.2k
    Capital one 3.5k

    I also owe a lawyer somewhere in the vicinity of 5K.

    My questions are,
    1. Will the Washington Mutual (JP MORGAN now) likely combine the two separate cards and come after me for both.

    2. Should I encourage my lawyer (Seperate issue)to rack up the charges to help my bolster my case for the bk? He does not know I am going bk, but I can tell him to bill me full price for everything.

    The amount of debt you have is irrelevant, so no, do not instruct your lawyer to overcharge.

    As for the Wamu issue, who can say. Most likely they will not combine them.

      I thought the amount of debt was relevant. Please explain.

      I won't encourage my lawyer to overcharge me, but I won't ask for a discount either.

        Nowhere in the bk code will you find any reference to a specific dollar amount of debt in order to file bk.

          My concern is that a court would find that I have the ability to pay back this debt, (which I don't). I just wanted to have enough debt to go though with in chapter 7 status. I don't think it should be a problem but additional lawyers fees would just put it so far out of reach that any court will recognize this and it would be a no-brainer. Where is my thinking faulty on this?

            AGAIN, the amount of debt you have has NOTHING to do with it. Remember, when you calculate your expenses, you EXCLUDE payments to your unsecured creditors.
