Finally made an appt. w/ attorney... Had to do it... I've known for a while BK was probably in our future but now DH is laid off.... doesn't take long to fall off the cliff when you have been teetering on the edge for so long! Time to pull my head out of the sand and deal with it. Deep breath.

The worst thing folks do when there is a financial crisis is bury their heads in the sand and go into denial and believe the fairy godmother will come with the magic wand and make it all go away. It doesn't....it just gets worse unless the lost income is replaced in a short period of time. Been there, understand. The worst thing to do is delay any action if no comparable job can be found within a few months because you just get further in debt and further ill from the stress. We waited over a year to file just trying not to file which was a bad mistake, using my husband's 401(k) and all our savings, then robbing Peter to pay Paul. Had we filed earlier, we may have saved his 401(k) and avoided running up further unnecessary debt._________________________________________

You'll feel better after you speak with your attorney. I know we did, we had hung on as long as we could. Make a list of questions before you go, this will help. We were in a fog when we went, but our attorney has been extremely helpful. It may take a while for you to gather up a retainer fee, it took us 3 months, but once you have it and they file, you will feel so much better. Just make sure to take care of yourself and get as much rest as you can. I did the best I could and still lost 15 pounds, (positive side - that's not always a bad thing!!) Go ahead and hit this thing head on, be proactive, life does get better!!!

As everyone else has stated, you will feel better after your appt with an attorney. We did the same thing, buried our heads, tried to hold on as long as possible before we just did it. I do recommend that you consult 3-4 attorneys before you retain one.

You all could not have been more right...
It took him about 5 minutes to say we should have no problem qualifying for a 7...
It seemed almost too easy.
We just need to wait til our tax returns come back so we can pay him... then file...
He was very nice, very informed, very "This is no big deal."
The whole "If it seems to good to be true" is ringing in my head though... Maybe I've read too many horror stories...
But the attorney doesn't think we will have any problems...
I know everyone here says to see 3-4 attorneys - I tried to meet with 2 based on recommendations on this forum - the one we saw today replied immediately (via email) the other (who is a trustee) never called back about setting an appt.
Should we see someone else? or go with this one?

I also finished my app today but I sent it via snail mail. Since the lawyer is about 60 miles away, I wasnt going to drive down there so I just insured it for $1000 and proof of delivery. I am still nervous. I haven't felt the pressure on my shoulder release yet. I opt to do the 341 without a lawyer present since my case is a semi normal no asset case.In three words I can sum up everything I've learned about life: "It goes on".
