    Question Moving out of country

    If I file for BK in the US would it affect me getting permanant residency or moving to another country?
    My wife is from New Zealand and wants to move back home but in order for me to work there I have to go through the proper channels.
    Does having a BK on your application for NZ residency affect that?
    I've searched the internet but haven't found anything. Even NZ immigration website.
    All of our debt is CC's.

    Or do I not file and just move?
    Any help would be appreciated.

    In the UK they don't check credit for Visa applications. NZ, well check their application form, simple as that. If you aren't coming back, just move. If at some point you want to return to live in the US again, well file. Get it over with.

      Complete the Application for Residence in New Zealand form (NZIS 1000) PDF. This form is also available from Immigration New Zealand offices in New Zealand and overseas.

      For each person included in your application you will also need to provide:

      • two recent passport-size photographs
      • a valid passport or certificate of identity
      • a completed Medical and X-ray Certificate form (NZIS 1007) PDF (Note: Pregnant women and children under the age of 11 years are not required to submit X-ray certificates unless a special report is required. For full details on health requirements, see our Health Requirements Leaflet (NZIS 1121) PDF)
      • a police certificate less than 6 months old for each applicant aged 17-years and over for each country of citizenship and each country in which they have lived for 12 months or more in the last 10 years.
      • a full birth certificate.
      • the application fee.

      The application is very long and seems to focus on criminal history and proof that you can afford to live in New Zealand. If you are considering bankruptcy here, you might run into trouble in the latter. Nonetheless, it would be best to straighten your finances out in US, as nc73 stated, in case you plan on returning one day. Do that first, then fill out the application and cross your fingers for an approval.

        See what searching can get you? No where does it mention credit check. If you have the cash and won't be a burden once you move, you should be fine. I doubt it asks if you were ever bankrupt either. I filled one out when moving to the UK and they were mainly concerned with how I will support myself and my family.

          Hey bud I am looking at heading oversees post-bk too. Nope, credit is absolutely not an issue when it comes to immigration.

          My choice is: Canada or Australia or New Zealand.

          So keep us posted on how your move comes along. Once we move creditors, fico scores, credit bureaus, pro-corporation/bank lobbying etc can all kiss my ass. I will be glad to move somewhere where we have consumer protection rather than the status quo here of: you used it, you bear the consequences.

            Follow up

            Hey Guys,
            Thanks for your input and we are in the process of getting all of our paper work together to move to NZ.
            I spoke with my attorney yesterday as I am doing the settlement way first and she said maybe not to settle if leaving the country.

            The only question I have is does anyone know if I don't pay, leave the country and say not come back for 5 yrs or so what would happen?

            Would the CC company's file a judgement against me and a warrant be out for my arrest? If I came through customs would they arrest me?

            She thinks most likely they will just consider it bad debt and write if off.

            Any thoughts on this would be great.

              Nah no chance. I just got back from the states and was fine. If you are worried you can do a background check yourself online before visiting. I did that to get a permanent job and it took a week, all online. I do have to wait 90 days to file from overseas though. Remember even though it is written off you still technically owe money still. Also you are judgement proof if you are out of the country.
