    chapter 12

    i am not new to forums so i used the search first brfore i started this post but i am a farmer and i am looking to maybe file a chapter 12 is what i was told was set up for family farmers and fisherman. I am both i am a family farmer of catfish and bass. i dont find anything about the 12 even though i have read what that is was looking for someone that has gone through it to ask some questions i have talked to a lawyer and he saaid some things that i would like to see if it was the same for them because the picture he was paionting me sure sounds good will give me my life back and i will get to keep the property the farm does anyone have any expertize or gone thru a chapter 12 and i am in Texas

    Wow. A Chapter 12 question. A catfish farmer. That sounds like Mississippi. 12 is not much different than 13. The primary difference being the amount of debt allowed.
    Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

      Ch12 looks very much like 13 with some different ceilings, etc.



      My guess is some of the gurus here would be able to work through your questions with you.

        While I am considered, in post count, a Guru, I have never dealt with a Chapter 12, although I'm familiar with it for "family" farmers. It's not the end-all and panacea. It was definitely meant for "small" family farmers. Depending on your debts, you could still end up in Chapter 11, or a Chapter 13 may be more appropriate.

        As such, I highly recommend a few consults with attorneys familiar with Chapter 12s. You probably won't find alot, unless you're in a predominantly family farming area.
