    I guess I started things in motion now

    This past Friday I finally met with an attorney. My sister got the names of 2 different BK attorneys from an old classmate of hers that is an attorney (not in BK). I met with the one that was said to deal with Ch7's more, since that's what my financial counselor had told me that my case should be.

    He seemed quite nice and straight-forward. I went in with 10-15 questions of my own that I didn't see definite answers to here since they were a little more case-specific I suppose you could say. He had no problem answering those questions for me.

    He said I'm a pretty straight-forward Ch7 and the his fees would be $1300. He said we would file under federal exemptions (MN gives the option) and I would be able to keep everything I have for assets.

    I still will meet with 2 or 3 other attorneys to have comparisons.

    Following the meeting with him I decided to call the financial service that I have the debt management program with and stopped the payments from being electronically withdrawn. They said they will "keep my file open" until I call them with attorney info once I've retained one. I will be able to do the required BK counseling through this organization, pre-filing and also pre-discharge.

    So, I'm feeling some relief having made those steps. I know there could still be some rough days ahead but I'm still feeling that this is the only option left really. I had a good talk with my parents about things (and was able to give them lots of info that I had learned from here!) and that was a relief to hear their thoughts about all of this. One of the things I told them was that I didn't really need them to support the decision but I wanted them to understand it. I now feel that they do understand it.

    I guess from here it's a matter of time until the phone calls begin.

    I plan on fixing my car and taking care of my standing dental bill (~$300) right away next pay-day. I can handle sleeping on the couch a little longer if it means I can file sooner.

    I haven't decided yet if I will sell my only good camera lens in order to help with attorney fees. The attorney I met with said that shouldn't be an issue as long as it's sold for fair market value and it's documented. Everyone in agreement with that statement?

    Thanks again for all of the wealth of information here!! I'm sure there will be additional research I will have to do yet and I bet I can find a chunk of my answers here.

    And, thank you for those that have offered input to me so far and that may do so in the future!!

    Your dental bill can be included in the BK...unless you need to pay ahead for work to be done. Don't pay it if you don't have to!

    Most of the time, attorneys advise you to stop paying absolutely everything not required for day to day living. This is how we saved enough to pay our attorney.

      I had thought about including it in the BK but discussing it with the dentist prior to filing. I would still like to have work done there I guess in the future. I'll have to think that one through a little bit yet...

        Don't sell your camera lens!! You were paying $900 to the DMP. You'll have attorney fees and filing fees in 2 months. Unless there is some reason to rush that you haven't mentioned in your posts, you have lots of time before your creditors sue and get a judgement.

        ETA: I do agree with your attorney that selling the lens for fair market value won't cause a problem with your BK. But, why sell your only good lens if you don't have to?

          Open a new bank account at a bank where you don't owe any money tomorrow! Then close your bank account you have used to pay anything automatically....several of my creditors were slow to stop taking out money!

          When you stop making the payments you may find that you have enough money to file.

            That is a good point about the lens. I guess I was just going to do it so the calling from the creditors would come to a halt sooner and I could file sooner. Chances are that, if I were to sell it, I'd probably buy the same lens again post-BK. So, you're right. I should just hang onto it. As you said, I should be able to file within 2 months. There's no unmentioned reason to rush faster than that than just to stop the calls.

            I don't owe any money at my bank. My debt is solely credit cards (and the little dental bill). However, I will make a call later today to double-check that the automated withdrawal was stopped by the DMP company. I talked to them on Friday at about 4:30pm and she said she would be able to make the change on Monday (yesterday). Other than that payment, I don't have any other automatic payments and my bank isn't affiliated with any of the creditors. The attorney I met with made it sound as though I shouldn't need to do anything with my bank account. I'll ask the next attorney that I consult with about it though to be sure.

I had caller ID added to my phone and just didn't answer the calls after telling each card once that I couldn't pay right now, am trying to work things out and may have a different answer in a month.

                      Thank you I might have been able to do the DMP if the monthly payments wouldn't have been so high. They can't say that I didn't try to pay them back...

                      I will take a look through that section. I only have a cell phone and I believe it will either be off or on vibrate soon! Anyone that usually calls me is up to speed on my status anyways...
