    Lawyer officially retained today. HUGE sigh of relief.

    Paid the retainer today. Whew. I feel like a big weight has been lifted just by doing THAT. I can't imagine how much better I'll feel when it's all officially OVER.

    We now have someone to refer to with questions, and legally representing us.

    I asked him about the "summons--but not really a summons" that came in the mail, and he said it could be a warning of something on the horizon. He said when we do actually get served to give him a call and he would file and answer to the lawsuit (which is covered in his fee).

    He spent an hour and a half going over the forms we have to fill out explaining what to do. He said don't stress yourself out over filling these out. If there is something that you are really stuck on, to call and they'd help, OR just put a question mark by it and we'd go over it at the next appt.

    He seems to think even though we're just over the median (he said about $900-$1000 over), we'd be fine for a Ch7, and that's how we'll proceed.

    It feels good to make this first step.

        I know the feeling JEM. I paid my attorney the retainer, but then I was worried about the balance, which was $1600, so on my payday, I woke up at 3 AM and ran to the bank and withdrew all the money to pay him. Why did I do this? I didn't want all the payday loans to hit my checking account before I did. LOL! Seriously, though, congrats!

          I am a little worried about coming up with the rest, but my mom is helping with what we need for the attorney. She knows everything that's going on, so if we have to list her as a creditor, we will. (Even though we will pay her back eventually) The attorney said it didn't matter too much either way if we list her as a creditor, or the money as a "gift".

            Congratulations and all the best with the upcoming bankruptcy filing! I think having representation made me feel even better than filing.

            You might want to ask your attorney about him sending opposing counsel a suggestion in bankruptcy so that lawsuit can be withdrawn if you are at the filing stage (meaning you received opposing counsel's notice that the suit has been filed or is to be filed very soon) right now. Don't let it get to the point of him having to file an answer. Just make it a nonsuit. My attorney did this and the whole process took less than a month. The local court sent me notice of the nonsuit even before my 341 hearing.

              Congratulations Jem!!!!!! That's great!

              I can't wait to file. Only today I had my first consult. Went very well. I have a tiny bit of relief. I can't wait to be where you are.

                Those bk questionaires are really something, huh? How many pages? Ours was about 40 I think!

                  Congratulations JEM! Having a good lawyer is really a big lifesaver. I know between having a good lawyer and this forum, the whole bankruptcy process has been fairly straightforward for me. It has made the whole process a lot easier.

                    We paid our retainer yesterday, so I completely understand the feeling of relief. Now I just have to get all the paperwork filled out.

                      This whole process is enough to make you go insane. I cannot WAIT until my appointment with the attorney. I am hoping within 2 weeks. Ahhhhhhhhhhhhhhhhhh!!! I am SO happy for you that your are in process. I wish you the absolute best!

                        I have interviewed one attorney so far (local bankruptcy mill), and we have an appointment with another next week (smaller firm).

                        We are scared to death at this point, but relieved that we have finally made a decision to go forward.
