    Question about paying attorney

    Does the trustee ever ask "How did you come up with the money to pay the lawyer?"

    I'm only asking because if I had the extra $1500 bucks laying around I probably could pay my bills on time....lol

    I was thinking of having a garage sale, to help with the lawyer fees. Is that a bad idea??

    Usually not. Attorney's fees are considered a necessary expense; so, for the most part, how you pay the attorney is not relevant. (so long as you didn't borrow the money from a creditor whose debt will be discharged in BK).

    If they do ask, just answer vaguely, e.g. I had a garage sale. You can sell assets prior to BK.

      in truth...i personally think they are more important that eating! but that's just me.

        Tobee! LOL. Anyway. Here's how I paid my lawyer. I didn't sleep much the night before my salary was direct deposited (3 days before I filed). I called and checked my account at 3 AM. Knowing that the payday loans hit my account at 6:00 AM, I hauled my butt to the nearest ATM at 3:00 AM (hoping I didn't get robbed) and withdrew the entire $1600, leaving a balance of $34. I got back into bed about 3:30. LOL. I felt bad and I also didn't feel bad. LOL. But my lawyer got paid and I got on the way to save future income. The sooner you file the better I thought.
        Filed August 20 341 on September 23 Report of No Distribution - September 24 Case Discharged and Closed on November 23!!!

          i so agree with you on that...

          i know many agree with this pro se thing. and i must say i give them tons of credit, but you know that saying something about he who defends himself has a fool for a client...

          now i'm NOT saying that those that file pro se are...NOT at all......it's just i (me, personally), would just be afraid that i do a good job on a regular basis of making myself look like a fool, no need for me to add to my list.

            Ditto on that one. One less thing to worry about for me.

              I agree with you there. The more potential problems I read about on here, the more attractive the idea of having an attorney became. The way I look at it is that bankruptcy is your chance for a fresh start. That money I spent on my attorney is the best investment I've made in years.

                i am with you 100% on that wondering.

                now, to find a GREAT atty is another story for another time. but one hopes people will shop around and make certain that they pick the right one! we did, have no regrets at all.
