    Post Discharge Question

    I filed Chapter 7 in December of 2009 and was discharged in March 2010. At that point in time all known creditors were included in the petition. Fast forward to today:

    It looks as though I may unanticipated medical expenses from October and November 2009. These are expenses that my insurance should have covered in full. Unfortunately due to the hospital improperly billing the insurance company and the insurance company not accepting the corrected billing due to an exceeded time frame I may be stuck with several hundred dollars in charges.

    My question is would it be acceptable to sent the hospital my discharge or not because they were not listed on the petition?
    Chapter 7 filed December 11, 2009, 341 Meeting held on January 7, 2010
    Deadline to File a Complaint: March 8, 2010

    Discharged and Closed March 11, 2010

    If your case was a "no asset" case then the omitted debt has been discharged. Send the creditor a copy of the Discharge. If your case was an "asset" case, meaning the Trustee had something to distribute to the creditors, the omitted debt was not discharged.
