    Florida Trustees

    A few questions:

    Who here (from FL) has had a trustee (or appraiser) come to your house to take inventory of personal items?

    What county?

    Just curious

    i have not...because we had no house...but, and the only reason i'm commenting here is there was another post from someone that it happened to i believe it was the "middle" district...and it was not the trustee themselves...they send out appraisers from what i understand.

      read what justbroke says about florida...it appears appraisers are usually sent out with "asset" cases.

        Yeah I saw that That's what got me thinking. I'm wondering how often it happens. Not that I have something to hide - I like to keep track of statistics.

          i think jb is here in florida....so he most likely knows a bit about the possibilities or the stats on what percentage get assigned an appraiser by the trustee.

          i think it so creepy...really...having someone rummaging through your belongings to see what they are worth.

          of course you have nothing to hide...it's just the thought to me that's creepy.

          actually....if it's ok with you can i or will you post this in our florida discussion group area...maybe someone who has experienced this would reply there???

            I'm in the florida middle district and had the trustee change our no asset ch7 to an asset and send out the appraiser. The appraiser valued our personal property over two grand over our allowed $2000 exemption so I'll be making payments to her for the next year. Our lawyer had four clients the day of our 341 and two of us got appraised.

              05...i'm just wondering...were you a "home" owner? or business owner.

              it seems from the threads i have read most trustee audit or send out appraisers, of course only when there is actually something to appraise...i'm throwing it out there, but one would likely believe someone who owns a home and is retaining it may have a higher change of the appraisal? now, that makes sense...but i really do not exactly know what they base it on, other than the trustee believes you have assets.

                I'm a modest home owner (around $110K ) we have equity in the house so we're keeping it. I was told by a para legal that it happens alot here in Florida if your house has equity and your keeping it. Not sure why, but it seems to happen quite often here in mid florida.

                  yes, i guess that's the point...if the trustee sees any chance of an asset, whether it's in the form of a house's equity and or the possessions in that house... they go for it. terrible!

                    We're in Florida Middle District--Jacksonville Courthouse. We were an Asset case, and there was nary a peep out of anyone of an appraiser coming to our home. I have read many threads that indicate the appraiser is sent for those that are in the Tampa Courthouse area.

                      yes...we also used tampa for our filing although we don't live there now, and you're right on that, i have heard many horror tales out of the tampa area...or district.

                      i really do wonder why that is?? one place in the very same state requiring more appraisals than others? doesn't seem to make much sense with one is still filing in the same state...but once again, i know it even changes here from county to county...it's enough to drive anyone nuts!

                        We filed in Ft. Myers district and I'm told the trustees there appraise aabout every third or forth case going through there.

                            i am currently going thru a financial " probe " from ft. hell trustee. it got turned into an asset case with appraisel. and i kept my home. without too many specifics she went back 29 months from date of filing,all banking records . 05mag and i were the " lucky 2" out of 4 our atty brought to 341 .so far this has been a nightmare .

                              i'm so sorry to hear your going through this.

                              i'm begining to "wonder", as i hear more and more of this happening, if this a beginning of a patterned, and may well be some type of "deterrent message" the bk courts are attempting to get out to the public, as a loud and clear....DO NOT FILE BK!!...just like the laws back in 2005...i'm certain the filings dropped as a result of the new laws taking effect. (maybe someone has the stats on that number?).
