    Can't file for a few weeks, problem?

    We've paid the attorney's fee, but need another pay period to get the filing fee. Is this going to be a problem if we don't file for another 3 weeks or so? I skipped a credit card payment for the first time in my life and am dreading the calls. I was hoping to file quickly to prevent many calls.

    When did you stop paying? I stopped about 2 months ago. I have given my attorney a fee and won't be able to pay the rest until a couple weeks. Only problem I have had is 30-40 calls a day from creditors but I just don't answer the phone. My lawyer says I will be fine until the end of this month. So depending on when you stopped paying.

      It's only been a week since something due wasn't paid.

        Not a problem. You might get a few calls-just ignore them-it gets easier by the day. If its only a couple of weeks you may not even get called before you file. Again, relax-it will be ok.

          You should be fine. Most banks won't pursue legal action until 90 days late. You will get calls and letters though. Read the Collections section of the forum, it will give you some good ideas about how to deal with them.

            I fell into the not being able to pay bills 2 years ago. I got mail a lot sometimes phone calls, but not really as they had my old cell phone number. I had just gotten a summons this January, Filed in March, and Automatic stay in place. It's been silent since. there is also the option to pay the filing fee in installments as well. you could always look into that.

              we waited 2 years and had our atty paid about 6 months before we filed. we needed to hold off to establish "legal" residency in our new home state. however, we were lucky since we the calls had stopped since no one knew where we were.

              i think you'll be fine!

                If your filing dont pay them period use that money to pay the lawyer,and stop beating yourself weve been there,it really sucks but you will overcome....Phone calls are nothing only when you get the summons do you have to really get busy that takes a while 9months for methen we had no choice but to file...

                  good point rusty and EVEN IF you get a summons to stall them you answer them. even go to court, but that process takes a bit longer than that.

                  actually, if you get a summons and you have an atty on retainer just hand it over to them.

                    Thanks! I'm pretty sure they don't have our new phone number so maybe it won't even happen. We'll have the money for the filing fee within a month since we're not paying the credit cards anymore.
