    Anybody had creditor objections?

    I guess one of the most unsure times for both a Chapter 7 and Chapter 13 person is the 60 day wait after the 341 meeting for creditors to object. Has anybody had any experience with a creditor filing an objection?

    If so, did they do it on the last day to object or much sooner?

    I guess I feel my creditors have already had about 40 days (close to 80 days now since my BK filing) now to file something and have not. Is this because they are slower than cold honey, or does it mean they probably won't file anything.

    Just curious, I wasn't too concerned after the 341 meeting, but as I get closer to that 60 day time frame, I am starting to worry some.

    I didn't have any objections, but I can try to calm your fears with regards to the end of your post. Most likely, the reason you haven't heard anything from your creditors is probably because you hadn't racked up a bunch of debt, and then filed BK within, let's say, a month or so. My understanding is that this is usually the cause for an objection to dicharge. Oh, and you may know this already, but the creditor can only object to the debt that you incurred with them.

    Creditors can also object to your exemptions, so if you do not have assets or or any items worth more than the exemptions for your state, then most likely, you won't hear a peep out of them.

    Chapter 7 filed - 10/12/2005 - Asset
    Discharged - 02/16/2006
    Case Closed - 11/08/2007

        Really hard to sit back and wait this part of the process out...... but believe me when it's all over, and you have a new beginning............. the long wait will be well worth it............

        There will be so much financial relief and stress relief in your lives.

        So be patient, twiddle your thumbs, sit back and read on the forum, and chat with us for a while since your waiting.............

        Remember, no news is good news.............. especially in bankruptcy.....

            From what I've heard, the longer the amount of time between when you last used your credit cards and the time you filed for bankruptcy, the better. And after about a year's time, most creditors won't object, because they have already charged off the accounts and sold them off to junk debt buyers who paid next to nothing for them, so they don't want to spend more than that trying to fight against your discharge of debts.
            The world's simplest C & D Letter:
            "I demand that you cease and desist from any communication with me."
            Notice that I never actually mention or acknowledge the debt in my letter.
