    Question Are medical debts dischargeable in a Chapter 7 if they are married?

    Are medical debts dischargeable in a Chapter 7 if they are only under the filing party's name? If the filing party is married, will the non-filing spouse be held liable for a spouse's medical debts in a Chapter 7? (In Colorado)

    That depends on how your state treats medical debt. in community property states, debts incurred during the course of a marriage are joint. In non-community property states, that is not the case. However, in many states, including mine which is Missouri, medical expenses are considered "necessary care" and by nature are considered joint. So, under a Chapter 7 filed in Missouri, medical bills can be collected from the non-filing party.
