    Can a filed bankruptcy be reported if it was dismissed within 2 months?

    Hello,

    I have waited out the 6 years to get most of my debts out of my reports. Unfortunately a bankruptcy (from May 2002) still shows on my credit reports even though I never had any debts discharged and it was dismissed before it was fully approved. I don't understand why I should have this black mark if I just filed for bankruptcy but never received any bankruptcy protection or, as I stated, had anything discharged. I still had to deal with the debtors calling and still have been paying my unsecured credit. Is this listing something I could challenge? Please help me out with any information, comment or suggestion. It would be greatly appreciated!

    You should try and dispute it, however it will probably come back verified. Unfortunately, it doesn't matter if the debts were discharged or not, the PR simply states the fact that you filed.

      Unfortunately once you filed bankruptcy, it doesn't matter that it was dismissed after just a few months. This 2002 bankruptcy will stay on your credit report until 2012. The best thing you can do is slowly rebuild your credit by ensuring all your payments are always on time. Only time - and lots of it - can help soften bankruptcy's impact on your credit scores. Since your bk was dismissed, that's a bigger negative to potential lenders than a filed bankruptcy that was successfully discharged and closed.

      Sorry the news isn't more positive. This is why it's so important to be certain you are doing the right thing when you file bankruptcy because once you do, there's no going back.

        Lrprn is right. A ch 7 will stay on your reports for 10 yrs. An old-law ch 13, if completed, will stay on your reports for 7 yrs unless it was dismissed or converted to a ch 7, then it will stay on for 10 yrs as well. It's the fact that you filed BK, not whether it was dismissed or discharged. Sorry I couldn't give you better news!

          Filling BK 7 will stay on report for ten years, and BK 13 for seven years.

            You can file an attachment memo to your credit bureau report for all creditors to see stating that your bankruptcy was "dismissed" and that you have paid all your debts yourself.

            This way the creditors and any future creditors will know that it was dismissed and never carried thru with.....

              Creditors don't give a hoot about Consumer Statements.
