I want to scream when I see my paralegal it is always something. I paid in full in March of this year still waiting. He was so lost on how to portray my ebay income. He apprears to have no clue what he is doing. He will ask me for new bank staements and stuff and say we a e gonna file and then another month rolls by . I have been nice a patient but I am losing it. The company has been around since the 70's with an okay report per BBB. They just have no idea what to do if you sell stuff on ebay and it is income.

I think I would checking into different lawyers. Usually there are free consultations you can go to just to see if they are more knowledgable.

Well i would have to get a refund then . He says my stuff is all typed up just about ready to file now. We'll see. I am scared to start over this has been alot of work .

If you don't feel comfortable with this person, don't file with this person. What if you had questions later on? Would that person be able to get you an answer within a reasonalbe amount of time? Remember, the lawyer works for you and if you don't like the pace of things, perhaps it's best to find someone who is up to your speed. Only you can decide that, though.

We are supposed to be dealing directly with the attorney & no paralegal at all. Everytime I see paralegal in a case there are problems. How much time have you dealt with the attorney & how much time with the paralegal? Is it like you ask the paralegal, the they ask the attroney, then the paralegal tells you the answer? This is important.

I just kind of had to laugh at that. It does not take seven months to find out what to do with stuff on Ebay.

Yah, it will be Thanksgiving soon. Do you think he likes pumpkin pie? Why do you need more bank statements. If you gave him six from the start you are now at over a year of bank statements. (?)

How much BK do they do?
Could you stop the Ebay for a month or is that a huge income for you? or small amount of income? I mean, if you could stop doing Ebay for awhile as in quitting for awhile (go back to it later) then would the attorney know what to do?

I hope you did not wait this long just to find out after filing they still do not know. Have you read through all the papers they say they have typed up & understand it all? This is very important.

Something does not sound right about all that, to me. I hope you get that worked out soon, stopthebleeding. I would say you do not have to be patient any longer because seriously, this whole thing should have been done & over by now, at the very least been to court once.

I must be missing something and this is just my two pennies...not advice, but I don't think I would be waiting until Thanksgiving to file. That is not right when you paid in March. On the other hand trying to force them to file when they don't have it all together after 7 months could be a mistake too.

It's possible that one of the reasons you are having so much trouble getting filed is that you seem to be asking a paralegal to give you legal advice. That's against the law in every US state. Paralegals are allowed to fill out the bk forms. They are NOT allowed to interpret what goes on the forms - that's a lawyer's job.

Is your paralegal operating independently or is he/she a part of a law office with lawyers supervising his/her practice?

I still have not met the attorney. My paralegal works in a big firm several lawers and several paralegals. I am filed as of today . I signed and went over all the papers the attorneys signature was on there. He said he had to make the attorney work on my case that he was going to have too turn her into there boss if she didn't . I paid in full in march. I will never be certain what took so long. I paid 2500 BTW. It seemed to be that my ebay income was messing things up . I did not stop because that woulkd have looked bad. actually i took a loss on it on taxes last year. I didn't want the trustee to think I stopped so I could file . I wanted them to see I am doing all I can to get out of this mess. The Ebay only makes 100 a month after alll expenses lol. It is a hobby that the state made me start collecting tax on so I filed fedral taxes and called it a loss and now a small income. I am so scared to death to not get my bankruptcy that i let them dick me around in a way. I had my husband call and give them hell. They are in a fancy building with a big office. I do feel like this sholud have been done by now. they have no choice but to keep it going now that i am filed. Court in 45 days right. Just to get the papers together was a lot of work for me. I didn't want to find a new attorney. I work , go to school and have 2 kids and do Ebay time is a factor here.

STB - we have ebay income too, but at the end of the year, it shows a loss, business is bad, but we told the Trustee we were hoping it would pick up in the next few years. He didn't seem to care other than wanted to know what we had in inventory. If it was anything extravagent he wanted it.
