New job - They do credit check.

    All,

Need some help. My wife might be getting a job in the Auto insurance field and to find out they do a credit check.

~ Now if they run a credit check and see a BK on it, is it possible that she might not get the job?

Oh side note. We have yet to file, but plan to in Jan/08, but if the employer runs the credit check and shows a low score, would they probably not hire her? Thanks

There's just no way to predict. Employers vary widely on how much weight they put on these scores or whether there's a history of bankruptcy. It is against the law to not hire someone solely because they filed bankruptcy, but it's easy to get around this if the employer really wants to.

Auto insurance doesn't strike me as a high-risk field for national security concerns or handling cash. Hopefully your wife's credit score or bk filing won't matter to this company and she will get the opportunity to show them how lucky they are to have hired her. My fingers are crossed that everything works out in her favor and she gets the job!

Might depend on the position. Doubt that the company will pull a credit check on agents/sales people, clerks, etc., but will most certainly pull a report on "money sensitive" positions to weed out folks who might accept bribes/kickbacks.

All I can tell you for sure, is that my husband was turned down for a job in the insurance industry solely for his credit score - I believe the position was to be a claims adjuster or something like that. The head guy doing the interviewing had great raport with him and told him, "as long as you pass the credit check, consider yourself hired." He got a rejection call 2 weeks later.

But, about a month later he GOT a job at a major insurance agency in the securities divison even though they did do a credit check.

We have not yet filed, so bk doesn't show yet, but our scores are in the toilet.

I don't believe it is against the law to hire on the basis of bankruptcy. I use to work at a bank and they would not only not hire you because of this, they would fire you if you filed while working there. Employers can't discriminate based on race, color, religion, sex or national origin, but to the best of my knowledge anything else is still open territory. It's not right, but still often the case.

Actually the current bankruptcy law specifically states that employers are not allowed to discriminate during hiring or can fire someone solely because they filed bankruptcy. What employers do is make up other plausible reasons to not hire or fire the individual to skirt the law. It's very hard for someone who has been discriminated against because they filed bankruptcy to prove it because the employers throw up so much dust to hide their true intent.

And don't forget - in the hiring process - all that employers really have to say is that they hired someone with "more experience" - which you cannot disprove. They will not say, or even hint, that they didn't hire you because you filed, because you're of different ethnic background (not white, etc.) You as the rejected applicant will never find out why they rejected you.
As far as "firing" is concrened - most, if not all states, are "right to work" laws states, where employers do not have to give you any reason whatsoever if and when they want to fire you.

Actually it is probably favorable to have a BK discharge over current delinquicies. Keep in mind they are likely looking for judgements or evidence of fraud. A disharged BK would mean that debt was examined and no fraud was found.
