tax refund?
Can this be real?? i thought i wasnt getting my refund this year because of my bk that was discharged 11-07. But it came in the mail today. is this a mistake? will the trustee ask for it later if i spend it? or is it mine?

In a Chapter 7 the trustee can take any portion of the a refund due and owing up to the date of the filing of your bankruptcy. The trustee may not have any portion of a refund for any years after you file the bankruptcy. However, this can get tricky as you enter the second half of the year. Just because it came to you does not mean you get to keep it. Ask your attorney but if the Trustee says he wants it, then he is most likely going to get it. An update.... WOO HOO!!!
I called my lawyer and they told me to turn it over to trustee. So i called the trustee for an address. But they said i can keep my return!!! Not to press the issue , i told them it was $3200 and they said i was good and to keep it.
