signed note and deed, but not on loan?

    signed note and deed, but not on loan?

    Does this make any sense? My husband and I bought our 1st home together in Nov 2005. We both signed all the loan docs, including the note and deed. However when the stmt comes, my name is not on it, nor when i call them will they speak to me since the don't have my name on loan. I AM on title though. My husband and I both worked in the mtg industry for years, and neither one of can firgure out why they'd take my name off, after signing docs. Anyone have any input on this?

    I know here in Ohio the spouse has to sign the title and etc, even though they were not put on the loan. When hubby and I bought our home in '06 it worked the same way. I am not on the loan. The mortgage people said they do this so that the spouse cannot buy property (such as for another woman to live) without the consent of the other spouse. I asked the same question.

      Well I am in CA. I've never really heard of this here though. I submitted all of my paystubs, etc, and they pulled my credit and i was never told that i'd not be on the loan. We weren't married at the time, actually.

        I had to submit my paystubs and things also. In the end it worked out to be a better loan (well not as bad of a loan) without me on it because I had no credit. Since you weren't married at the time though I have no idea.

          You should have a copy of all your paperwork from Nov. 2005 when you bought the home - pull it out and review it. You state your name is not on the "statement" when it comes; that does not mean it is not on the mortgage/loan docs. It may mean they just have the loan as filed under the primary signer just as the IRS does on its joint returns (when you call, you have to give the SS # of the primary return signer if joint). A review of your paperwork and a call to your mortgage dept. by your husband or both of you will clear this up.

            IF for some reason, we find out that someone really did screw up and remove me fromt he loan after signing, would that be something fraudulant? Would it void the mtg? Hey maybe we'd end up with a free home???

              Here is my situation and although having a Bk Lawyer he will not help as he says he is just there for the BK.
              I divorced in July of 06 signing over the house my ex was living in to her with me retaining the house I am living in, this year August I filed for BK 7 surrendering my house and any interest that might have been in the house that she is living in, now according to my Lawyer that did not mean I had surrendered her house just my interest, now I have come to find out that my name is the only name on the Note although mine and hers are on both the Deed and the Mortgage statement as Owner/Borrower, and we have been told from the Mortgage company that we need an Attorney as I have surrendered that Property as well. One other point here is the fact that I had state in the divorce agreement that I would maintain the mortgage payments and have been doing so from we bought the house right through the divorce till 3 months ago as the bottom of my bucket fell out and I am loosing everything , I am asking if there is anyone out there with the knowledge about this sort of situation to please edify me as to what you think we should do, I really do not want her to loose this house but what are our options.
