Anonymuse,
Just might make it there also, before its all over with..... never know....
Depends on how I'm treated when I start down this path.....
If I have a lot of problems or smartasses in the way, yep, I can send the right letter to the right person and possible get it on the news or Dateline/ 20/20... etc.....
They love it when society beats up on senior citizens...... especially when corporations do it......
So, we'll see how it goes......
But their going to give me what I want......... they are going to repay me every dime I had invested in my home/property...... + doctor bills from the stress............... + compensation for their "stupidity"................ for disrupting my life for the last 2 years........
So we'll see how hard they want to "fight" - cause this ole girl has LOTS OF FIGHT IN HER........... and it's time to take the gloves off...............Minny

Another Update Again
As soon as the Judge called for the hearing, the Trustee sent out a Notice to Creditors that assets were available and for them to file.... this will still extend my case another 3 months..... possibly 6 months or more....
They knew there was assets 2 years ago at the 341 meeting and were supposed to file a claim then..... what's the holdup???
Besides, the Trustee had already designated 1/2 of the proceeds from the sale of my home to the Mortgage Company... (the very people who commited "lender negligence" - ain't that a "crock of s***) the very Company that created the problem will benefit the most from the sale......
When they screwed up the title they became and "unsecured creditor" just like the cc companies..... yet they will benefit 1/2 of the proceeds..... DUH!!! Sounds like a "deal" to me between Trustee and Mortgage Company.....
Another thing, when the Trustee seized my home, the Mortage Company never did declare me in "default on my note" or do a foreclosure on the land mortgage issue..... INTERESTING, HUH.............
We'll see what the future brings..............Minny

NOPE - NO ANSWERS FROM ANYONE EXCEPT THE LONG ARM OF THE COURT CAN DO WHATEVER THEY WANT TOO............
That is a question that will be brought up legally later........... as you said the house was not "legally mine" (still in sellers name).... so how could they sell something that was not mine but still legally belonged to someone else.....
(I was told something about possession is 9 tenths of the law)..... yeah, sure....
There was an item sold at auction that was not mine either. Was not in the petition from the Court to sell either, yet it was sold......
Another good question to find out why they thought they could sell it....
The petiion to the Court that was granted by the judge "specifically" stated home and land only............. to be auctioned.... nothing else......
Lots of things in my case - that wasn't "right"..........
Lots to pursue in Court..............Minny

Hooray for Minnie! Kick 'em where it counts.
Another thing to take into consideration:
When you bought your home, the title company, or mortgage company that you bought it from would have had to put title insurance on it, BY LAW. That would cover any and all title defects, and put it back on thier butt.
I would consider looking into that too, and going after them for their negligence of title perfection. That would have saved a lot of this hassle.
The Trustee is a bastard. Just realize that you are the better person in all of this, and move on... you'll be closed soon!BUSY running my own credit repair services! Sorry I don't stop in so often any more!

Tin,
First thing I told my attorney was I had title insurance, DUH, he said makes no difference......... Trustee is taking anyways....
But yes the title insurance will sure help when I go after them...... that just gives me another party to sue in the outcome......
So far, THEY ALL are standing in line, waiting on "certified mail"!!!!!Minny

Just hope you develop the wisdom and the patience that goes with it also.....
At my age, I don't get mad, I just get EVEN........
My grandpa always told me "if a man can make you mad, he proved he was smarter than you were".....
And believe me I have lived by that quote.....
Grandpa was a preacher for 40 years and worked in the coal mines....Minny
