    bank account locked HELP PLEASE ASAP!

    Hello there, I am in some deep water i think, I personally have a judgement againt me for the sum of 10000.00. I no longer have a bank account myself, mainly for that reason.

    I received a personal check from a friend, i signed the back of it and gave it to my father to deposit in his personal account, he endorsed the back and we deposited it, we waited 7 business days, the check cleared then he wrote me a check for 10000, which i went right over to his bank and cashed, no problems, well that was last week, now my FATHER has HIS account .


    does that sound right?

    Maybe its just me, but I really didn't understand your post. Maybe you would want to clarify things for us.

      What I am asking is, could the guy that I owe the judgement to, have MY FATHERS's account seized? I recieved a check and endorsed it, he(my father) endorsed under my name and deposited it in HIS account. The check cleared some days later, and as of today, no his account is locked? Could my judgement affect HIS account? we dont share the account, i just had him deposit the check so it could clear.......is that any clearer? hard to explain i guess lol

          Yes as of today, its froze, needless to say Hes not too pleased with me, but i thought they couldnt touch him, it seems way out of line.. the check was written to me, i had him sign and deposit in his own persoanl account, thats why i thought it was so strange, i thought maybe there was a loop hole they could get to his account because the check was written to me....

            I don't know for sure. Why doesn't he contact them and find out? Maybe they just froze it because a check that large was signed over to him, as a fraud prevention measure.

              I hope so, it was too late today to contact the bank other then their automated system, i was tryin to have answers for him in the morning, thanks for your help, much appreciated

                First, I would let you know, that my friend's son had his account and EVERY THING frozen on him. He is a regular Joe, and he deposited his paycheck and next thing he finds out is his account was frozen. My Friend's son went into the bank and raised hell, almost got arrested, they let him have $60 for the week, the bank and they said it was the "patriot act" because of the government?
                I thought it was a a joke, but the accounts can be frozen for 7 days, it's like "big brother" is watching. It is common in LARGE transactions like that. It was because of the "crack down" on terrorists activity and funding...they check into every thing. There was a story about a nun had her account frozen, it sounds like a joke , but look in to it. I laughed when I first heard it. I checked on Snopes.com, and all it mentions is about an email sent out about the "act" was false. I don't know maybe it is all a joke, but I know his account was frozen also and they was no ryhme or reason to it?

                Second of all, if it went down like you said in that time frame, it is my opinion that it is way too soon, for them to track down that account and get a judge to freeze it, plus, they have to have a judgment against you father in order to touch his account, do you guys have the same name??
                I'd look into other possibilities.

                  no, we have diff first names. the judgement against me has been in place for around 6 months

                    Any cash transaction over a certain amount, legally must be reported by the bank to the government. They may have frozen that account to investigate why 10K was taken out in cash. This was a law long before the patriot act. I want to say that cash amount is 8K...but not 100% sure on that.

                    If you would have gotten two 5000 checks and cashed them different days, nothing would have been reported.

                    This, in my opinion, has nothing to do with the judgement against you. It has merely to do with the sum of money you got out as cash. Uncle Sam probably wants to talk to you and your dad soon.

                      God help us when the "Patriot Act" and "Fatherland", excuse me "Homeland" Security are used against everyday folks. That day may be here, but it is definitely coming, freezing accounts WITHOUT a Judges Order? My living God.

                        It used to be, and it may have changed, that movement of amounts of $10K or more were automatically reported by the Banks to the Government.

                        If you go and withdraw $10K, it automatically gets reported. If you deposit $10K, it automatically gets reported.

                        It's untelling what's going on with the Bank. It could be because your father deposited a check written to you into his acct. It could be because of Homeland Security and the Patriot Act.

                        It may have to do with the way your Garnishment was written. Was it a wage Garnishment or a Bank Acct Garnishment?? If it's a Bank Acct Garnishment and your father Banks at the same Bank as you did, the Bank could be investigating.

                        Your father needs to call the bank and find out why the Bank has frozen his acct.

                          Is your dad's account at the same bank as yours?

                          Pre-patriot act (1998 I think) I had an account frozen for a week. I received $13K inheritance, but it wasn't a big deal since they still kept my checking going. It's the whole "anything over $10K being reported to the government."

                            If the depoist is outside your fathers normal banking depoists it may have flagged the account.
                            My credit scores:
                            Before Filing: Tr 496, Ex 496, Eq 507

                            Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

                              I think the $10K regulation is alive and well...several years ago we deposited a check from a Vanguard account for $17K and the bank would not let us touch it for 5 days. I know you are worried about the judgement but I think it is more about the amount of the check, etc; bottom line is instead of all of us speculating what is going on your dad should call and find out why. Also, robivi I am right there with you about the bank freezing anything...our bank, formerly NBC and now Suntrust, will not let us touch a deposit until after midnight no matter what...maybe it is the norm but last time I checked it was OUR money....we are moving our millions to our credit union....
