Hey, keep up with your PACER check. I would check at least once a week (maybe twice)... just in case of any deficiencies.

Best wishes.

Rather than repeat a lot that has been said about PACER... try searching for PACER (by title only) in the Forums.

You can get addicted to PACER, but EVERY Pro Se debtor must have PACER in my book. This is the only way to stay on top of your case.

Great job! Congrats on getting the filing fee waived too! As justbroke said, make sure you're checking pacer for deficiencies and due dates. Sounds like you're in great shape though!

Just watch pacer and also pay attention to anything from the trustee about what they want before the meeting. I misread my letter and thought they wanted all of the required documents AT the meeting. It was actually 2 weeks before the meeting that they wanted them. Oops. I'm also one of those who wants to make sure everything is done as quickly as possible rather than waiting to the last minute when it comes to something like bk so I would take the post petition counseling course the day after the 341 meeting.

My bk should've been really easy since I am a no asset case but I missed a couple of things that made it more of a hassle. Even with that, it wasn't that bad. It's all about procedure and research if you make a mistake and they can all be corrected. I learned a lot through the process and now wish I'd gone to law school :)

so, what the trustee wants will come to me in a letter or on pacer?

so, what the trustee wants will come to me in a letter or on pacer? If they Trustee has a request, then it comes to you by phone and/or by mail. If the Trustee wants the Judge to do something to you... it comes via PACER. :)

to get the fee waived all you have to do is fill out form B3B (Application for Waiver of Chapter 7 Filing Fee) which you can find on the internet. i will tell you that you have to be under what they call poverty level. follow this link to see the chart on if you fall in the poverty levels http://www.uscourts.gov/bankruptcycourts/povertyguidelines2009.pdf after you check to see if you fall with in the guide lines and you see that you do when you file you file the B3B form and a judge reviews it and decides if you are granted the waiver or not. make sure that you fill out all of your paperwork before you file so the judge can have as much information as possible. i hope this helped if you need more answers please ask.

ok thanks...oh yeah how fast is my case on pacer? The actually case is there immediately upon filing. The documents start appearing within a few days (the Notice of Bankruptcy and other such case initiation items). If you file through an attorney, then the petition is submitted electronically, it should also show up pretty quickly (unless the Case Manager has to review docketed items first).

The list shows $1353.75 monthly and I am guessing that is before taxes? Right now I am bringing home before taxes $1808 so I am guessing I don't count.

Eli, if you're talking about the Fee Waiver, then it would be pre-tax (gross) income.

just as justbroke said it is before taxes so if you are at $1808 then yeah you would be beyond the $1353.75 and may not qualify to have fee waived.

I wanted to be open and honest and tell you that it made me chuckle! :)

"JTL" are the Judge's initials. The Case Number usually looks like this: 09-XXXXX-ABC where "09" is the year, XXXXX is the case number and ABC is the presiding Judge.

WOW!!!LOL!!! thanks that is funny...so does it matter if i put that on there as a part of the case number or what? No, it doesn't really matter. They use it for case administration so that it's easy to see which Judge it's assigned to. In some Districts, they also have other 3-digit suffices which not only tell the Judge, but also which sub-division and Chapter of Bankruptcy.

For example: 09-XXXXX-A83 would be Case No. XXXXX in 2009 for Judge ABC, that's in "8" Division for a Chapter 13.

I know it may be confusing, but it helps the Trustee and Court personnel know who the Judge is, what case it is, etc, etc.

You do not need to include it. You can always reference your account as 09-XXXXX so long as you mention which District, Division and Judge.

Just in case they say they didn't get them.

You need to come prepared like a lawyer. Err... you need to come better prepared than a lawyer as far as documentation. :)

ok so if i dont get a letter in the mail saying i need to bring anything then maybe just take it upon myself and maybe bring a couple copies of everything to include my taxes and all paper that have beeb filed with the court. and if i do get a letter from the trustee i should send what he has asked for but also take a coule copies with me to the meeting.

There are certain things that need to be filed at least 7 days before the 341 Meeting. You should probably check your Trustee's website for further information. I would be inclined to call the Trustee's office to see what they need prior to the meeting.

i had my 431 meeting today and all went well. the trustee told me that i did a great job on my paperwork and even said that he wishes others would take time to do such a good job. but anyways they asked me a bunch of questions and then since i filed pro se he had another set of questions but all went well. he said someone else may call just to verify the questions that he asked me as far as the pro se goes but he doesnt think they will call.

also i got a letter in the mail today from someone that wants to be added to the matrix so he can be notified, whats up with that and how do i add him. he is a lawyer for a hospital i owe. any input on why he would want to be notified and how to add him?

justbroke
08-06-2009, 10:29 PM
You personally don't need to add them. They are asking for the Court to "notice" them by entering an "appearance" on behalf of some creditor. It usually also contains a message asking for all papers in the case to be sent to them.

Now, the Clerk will update the mailing matrix. If you ever need to serve anything on all the creditors, or even that specific creditor... get the latest matrix from PACER to make sure you have the right addresses.

Nice job!
