  • Dentist Bill included in our Bankruptcy

Hi. My question - has anyone else had to do put your doctor/dentist in your bankruptcy and have to find a new doctor/dentist?
Did you have issues finding a new dentist because because of this? I\m concerned the new office will refuse us care because they will find out about our bankruptcy.

I owe about 400.00 to our dentist. Ive been going to them for at least 10 years. I went ahead and put them in our BK.

I already spoke to the dental office manager and told her that we had to file BK and couldn't/wouldn't be paying my bill. They wont see us until its paid - Not surprisingly we have to find a new dentist (which is fine) Thanks

If you are able to pay the bill, you can pay it even if it is included in your BK. The trustee will still pay them if they file a claim, but they can either refund it to you or apply it towards future care.

I don't think the BK will keep another dentist from treating you, but they may insist on being paid in advance of treatment.

Although I am not one of the BK gurus, I can share my experience. I too, filed for BK13 in February of last year and considered including my CareCredit bill but reconsidered because I knew if I did, we would also need to find a new dentist so we paid that one off before filing. For $400 can you remove them and pay them outside the plan? The gurus may say this is a preferential bill and if so I stand corrected ,but it seems a shame you should have to find a new provider over such a measly amount. Of course I don't know know the totality of your circumstances and how desperate you may be to file now.
I have been going to this dentist for over eight years (since we first moved to Colorado from the East Coast) and he is aware of our financial situation and although my current dental situation has reached a crisis point (I will likely have to have a crowned tooth pulled because of fresh decay underneath - I can't afford the $1000 root canal treatment, followed by a $1250 crown ), I still intend to stay with him until I can no longer afford dental care or he retires (He is already 70+) I must also deal with periodontal disease which is expensive to treat and I am not ready for dentures -HAHA! (I have maxed out our $1500 insurance coverage for me on a crown and root canal on another tooth and one cleaning already this year .) My husband's current insurance covers dental implants at 60% so beginning in January we will try if allowed to begin that process. If I had the funds or credit as I had before, then I might do things differently, but BK13 affects you adversely when you are faced with situations where you must prepay (major dental work, surgery, plumbing or other household emergencies, sudden catastrophic car accidents or repair.) "Bugeting like a boss" and "cutting to the bone" is not likely to help you save the thousands of dollars up you will need for an expensive life event especially when you are forbidden to have any disposable income and you are struggling to pay off past due medical bills from last year as we are!
Good luck with finding a way to pay off your dentist, or finding another who is willing to deal with your BK.
Life is not supposed to be fair, so why would any one expect any thing else from bankruptcy?

I thought of that for a moment, but it is dischargeable unsecured debt. Unless 100% of unsecured debt is getting paid, then the dentist would get paid only a portion of the $400 over the life of the plan. The dentist can remove himself from the plan by not filing a claim, but then he risks Leahnc not paying and losing whatever he would have received in the plan. It is such a small amount that he may not file a claim anyway.
