    36 month mark?

    Hi all....

    Haven't been on in a while. I am with the OLD LAW BK 13. I'd like to know when does your payment count start? My payment amount was changed 3 times, going up each time. I am on a 60 month plan. Sept 2004 was first payment made but when we were FINALLY confirmed which was a year later, I noticed that our first 2 payment weren't count towards our 60. Right now it states that we have 26 more to go but in reality we should have 24 to go as we made 36 payments already. The only thing I can think of is that they took the first 2 payments to make up for the payment inceases.

    Does this sound right?

    Now also do I go by what my trustee says I have left or by how many payments I actually already made? I am so confused?

    Has anyone in PA finished their BK, if so, how long did the closing take?

    Best thing to do is contact your lawyer. He/she can straighten this out for you.

    If forced to make a choice, personally I'd keep on paying every month until your trustee says you're done.

      I am looking to do a pay-off at 36 months that is why I was asking the question as to when the payment count starts.

          Ask your attorney to obtain for you a print out from the BK Court/Trustee of your case to date which will show all your payments made and to what creditors they were disbursed and what is owed. Your attorney can explain to you what occurred or if there actually is an error as to your first two payments not being credited. You should be receiving each year from your Trustee a complete print out of your Plan (what you paid in/what was paid out and to who). If you are not receiving that, inquire why. Your Plan payments start with your first payment which is due 30 days after you file so that is Number 1.

            My payment amount increased from the original plan to the confirmed plan. My attorney told me I must make up the difference, at my convience, or would have to make a larger last payment.

            Your plan will more than likely require you to make 60 monthly payments at the "confirmed" amount. I'm sure that is the issue with your account now. You may want to contact the trustee or your attorney for clarification.
