I gave my atty all my information in early February. He has not filed yet. What seems to be the typical time line from getting info to atty to the 341 meeting or the atty actually filing?

Often in Ch 13, there are good reasons to wait to file. What does your lawyer say when you ask about the delay?Originally posted by howie View PostI gave my atty all my information in early February. It could be a few days to several months depending upon the circumstances and any rush need to file. We retained our attorney early in February 2002 and filed mid-April 2002. There are others that have shorter or longer time spans. Give your attorney a call and see what is going on._________________________________________

I did talk to a legal assistant at the atty office. She just says he is backed up. I am going to have to pay 100% back. I am not paying any creditors right now. So, I am having extra money every month until I have to start paying. My atty said I am not to have more than 400 dollars in the bank at the 341 meeting. I am worried the trustee will wonder where all the extra money went. Anyone every experienced a similar situation?

I know with our attorney we were not a priority becuase we were not loosing our house, being sued real soon or anything like that, so it took a while. The office people were nice and explained that they had recent jump in the number of people filing to save thier homes. And were about to start on our paperwork so it took a couple a months.

if you're proposing 100% payback, it's very unlikely the trustee is going to get nasty questioning where your money is going prior to filing. As long as the attorney fills the paperwork out correctly, they shouldn't have a thing to complain about, they are going to get the maximum amount of payback from you so there's no reason for the trustee to get aggressive on the creditor's behalf.
My attorney filed my paperwork the day after I met with her to sign the papers. Not sure what the backlog is on your lawyers part is if you've already done all the paperwork...Filed CH 13 September 17, 2007
