    Audit at the END?

    FIVE more months to go...where O where has the time gone?

    At the start my GDaughter was just barely a toddler and I remember thinking, "she'll be starting school by the time this BK is over."
    And here we are almost time to start "real school"!

    My question is about the audit at the end? This audit is done to make sure all the payments have been made and have been paid, right?

    I called my attorneys office and was told to contact the trustees office for correct information? I was under the impression that was off limits but guess not?

    I also asked about the check we are all expecting and was told (not by attorney) that if trustee had not asked for tax returns etc., then the check was yours to keep. Bare in mind that this is in W.Washington.

    If and when I find out anything, I'll be sure to post.

    I can tell you that trustees office raised my payment 6 months ago, by $40 a month due to some sort of shortage, not sure what was the cause. I thought it odd that the attorneys office didn't let me know.....maybe their mistake? Guess someone thought I could just pull the extra outta my left ear? So I did

    When you send in your last payment, the trustee will audit your Plan and send out all remaining payments to the creditors and also send them a document to sign and return to him/her. When all those signed documents are received by the Trustee and the audit complete, you will receive your discharge. It usually takes about 90 days but could take longer. You should receive a letter from your Trustee when the process starts informing you of the timeframe involved and what will be occurring during those 90 days.

      what if a creditor refuses to sign the letter that states they have received all of the money they are going to get? I have 1 creditor that is awful and my fear is that he won't sign it!!!

        The document is something they sign that they have received the funds due them under your Plan. Since they agreed at the outset as to the amount, there shouldn't be any problem.

          So does the trustee let you know the time frame of that "last" payment?
          I mean from what I see on the NDS, the balance divided by the amount of the payment gives the "last" payment to be paid in August. Do you just stop then OR keep paying until you are notified ?

          I am aware this has discussed before however it seems that every trustee office/state is or can be different.

          Ya can't blame me for "over asking" since there is an air of joy here.

          I hope someone from W.WA responds.

            I am planning to wait until I have something in writing from the trustee that states DO NOT SEND IN ANY MORE MONEY. When we were dismissed, I received 2 such letters. This time I can't wait to get that letter cause it means I will be DONE!

              You should keep paying until you get notice to stop. This may take a while, or your trustee may be on the ball. I have heard of it taking up to 6 months. Ours noticed the next month and sent in the court order to stop the payroll deductions.
              If you do overpay, it will be refunded, we had a month and half refunded to us after they stopped taking our payments/

                End in sight, looks like we will be finishing about the same time. We send our payments to the trustee, I wonder if once I have paid the balance if I can call and ask about whether or not we need to continue sending payments?

                  Check with your lawyer - he/she can tell you what to expect and if it's ok to contact the trustee directly about the last payment.

                    I contacted the trustee yesterday because I noticed that the payments to my creditors in May are all reserved (not being made). And then in June, those payments all have () around them. The lady at the trustee's office said, "Hmmmm, you are in review. You will have to call back another day to get your answer. You must be real close to the end of your case." Wow. So I called my attorney. He said that was a good sign. So my end might be in sight here real soon!!!!
