          Back on subject.

I guess I am at a loss as to a lot of these posts. Why would you offer any info to the trustee that he/she does not specifically ask for. I know I have read through my 13 paperwork several times and it is so filled with possible loop holes you could have a field day with it. I personally view my 13 as a punishment for being an idiot with my finances, it is my debtors prison. With that I also think that the companies that added excesive fees and penalties ( the US goverment via the IRS included ) are getting away with murder. This being said, if I can find a way to make extra money ( legally ) I am going to. If it means Ebay, gifts, cash side jobs... anything I am going to do it so that my family can live a decent life without having to pay for my stupidity.

My trustee said straight out, make my payments, pay my mortgage and don't take out any credit. He never said, tell me if grandma gives you money or if you put in a floor for cash or if you sell your stereo on ebay I want to know I go with the theory that if I don't report it on my taxes I don't report it to the trustee.

I don't think the Trustee would be very interested in your $9 windfall but if you'd like to inform him, you can.

We're not talking about $9 here and before you start being disrespectful to Flamingo, who knows what she is talking about, you better just keep keep your snide comments to yourself.
Thanks Mike but we all know there are folks who just can't handle what goes along with filing BK even when/if reality jumps up and slaps them in the face.

WOW! I haven't checked the forum in a while and when I saw my original post had so many responses, I thought "AWESOME!!" Then when I started reading this high school cat fight I thought, "Uh, oh!"

Thanks tofargone for getting back to the original post. I agree with your comments. I too re-read our paperwork and went through old posts on this forum to figure out what would need to be reported and what wouldn't. We already told our attorney about his and she said to just keep selling stuff but to keep that money separate from our wages so it is traceable. I guess that is what makes me think I would need to then disclose it to the trustee. However, I have NO IDEA ho wmuch $ we'd make from Ebay and how consistent the cash flow would be and I definately wouldn't call it a 2nd income. So, with your help, I guess I have answered my own question.

Thanks again and I hope no hard feelings exist from all the previous posts. We are all here for a reason and like other boards, looking for support is number one, at least for me. Have a great day!

A lot of us question a lot of stuff involved in a Chapter 13. However, we all know when going into one that your financial estate from the day you file until the day you are discharged is under the control of the Trustee and all your income and outgo can be requested by him/her at any time. I, myself, never treated that lightly and successfully got through our Chapter 13, even being able to buy out early, by reporting everything and flying low under the radar as necessary. I did not want to risk dismissal or play games. If others do, that is up to them and they don't have to take or listen to advice or experiences on here by others but handle their plan as they wish to handle it.

I agree Flamingo as you say you made it through yours so you are a much better resourse than myself who has only been playing the game for a little over a year.

I also think a lot depends on the trustee and the area where you are. It seems that some people have real sticklers for trustees who take their job to the nth degree. Mine doesn't seem to care about anything outside payments. It is also good to note that I am pretty close to 100% payoff and my secured is 80% of the plan so even if the trustee came back and wanted me at a full 100% to unsecured it would be about another 2K.

I think that what everyone needs to know is that We are not experts on the subject, we are or have been just living through it. All of us have different issues and all of our casses are different. I may sound like I am playing this all fast and loose, but I assure you I have a great attorney that I pass everything through.

                      FLamingo-

Thanks for your posts, it is inspiring to see that people can make it succesfully through a 13. How did you buy out early? Did you re-finance your mortgage?
