Buyout

Can you please explain more about your buyout situation?

I filed in Oct 2004, confirmed Jan 2005.
My plan currently shows about 6500 due on secured ( vehicles in cram down )
I would love to try and buy out. It seems when I ask the attorney, I dont always get a clear answer. I made a mistake of going to one of those mega bankruptcy attorneys, that don't really care about their clients, just care about the money.
Seems they don't want to be involved with me anymore.

Does anyone think another attorney may be able to help get a buyout?

Financially everything is great now, just need to get discharged so I can get on with life

First, Congrats to the OP on your discharge!


Secondly, as to crookedoak's inquiry as to a buyout....do you have enough equity in your home to pay off the balance of your plan (secured and unsecured)? If so, you first need to consult with your attorney about the situation and obtain trustee permission to buy out. A lot is involved and your first step is to work with your attorney to initiate the process. Note, there will be additional fees to buy out of your Plan as it involves additional work (Motion filing, etc.). If necessary, contact your attorney's office and advise his assistant or paralegal you are interested in buying out of your Plan and need to consult with the attorney - you did pay him/her to represent you during your 13 and he/she is responsible for advising you as to this situation.

well if I could give you some insight of what is going on with me right now. In April, we decided to contact our loser attorney because we wanted to refi for a lower rate and buy out. Well, no response and his office staff are TERRIBLE! He got $2500 at filing and tacked on another $1200 in our 13 when he convinced us to NOT file 7, but 13. Well, we took the initative to contact the trustee and he wrote us a letter stating we could do the buyout since we have had 3yrs of on time payments and the only way we could buyout is if we paid off the 13. We are on day 3 of our file being at the underwriter waiting for the clear to close. Once that happens we can close, and they will contact the trustee and payoff our balance.

To answer crookedoak's question. We saved every penny we could to do the buy out. How? Well, we cut back on a lot of things that were included in our bk allowance. We had a very good lawyer and I must say trustee. Total buy-out time took 2 months from last payment.
