    We made it & question

We filed a CH13 back in 2003 and finished this past April. It was hard to believe...but we made it. This site was a great resource during those days, so thanks to everyone. Here is my question. We received our final account and report yesterday from the Western District that shows the completed...but is also shows a "Debtor Refund" in the list of disbursements. Has anyone else seen this? Is this something that I should expect a check on or is it just a mirage?

Thanks for any information and for those still in the process...YOU WILL MAKE IT!

We also had something similar but in letter form from our Trustee and when we inquired we were advised that paragraph should not have been included in our latter and was just part of a "form" letter sent out to debtors prior to discharge. If you sent in extra payments or there was another change in your Plan resulting in an overage, you will receive a refund. However, to be on the safe side before you get all excited as we did, call your attorney and ask. Hope you do have one though!

A huge high-five for finishing your Ch 13 successfully! That is such an achievement - way to go! We're two years in - so far, so good.

As Flamingo noted, if your trustee had extra funds left after your case audit was completed, then yes, you will get those funds back from the trustee as a check. When is hard to say, but hopefully will be in the next few weeks since your case is officially discharged.

If you think it might be part of a form letter , I'd call your lawyer to see what he/she thinks.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

                Got refund check

We also finished paying in Dec 07 our 3yr CH 13 100% payback and just today on pacer finally got the letter closing the case & saying we will be getting our discharge, Back in July we did receive almost $8,000.00 back big happy dance! :After everyone was payed off initially we were only 75% payback & when we had so much money left they went back & increased us to 100% and sent out another check to everyone paid the trustee & then we got what was left. Hopefully the discharge paper any day Though I was sure I had read you get the discharge then close. Our entire time has been backward though so what would I expect.Hope you get a check also
