    Buying a used car with cash before filing

    It looks as though I'll be filing for a chapter 13 soon. My child will be needing transportation in the next few months and I have the opportunity to pay $900 cash for a used car. If I go ahead and get this car while I can, will this be an issue for me when I file?

    Given the limited information you've shared, your trustee may care if you can't protect the car with your MS bk exemptions. Can you? Also if asked, can you prove the car was a necessity?

        Normally the personal property exemption is to be used for all of your personal property - everything (clothing, furniture, bank accounts, autos etc). Sometimes the exemptions are specific (like here in Fl we can only have a $1000 auto exemption). So check your states' exemptions to make sure there are no limitations on how to use that $10,000.
