    Becky, have you already filed Ch 13? Is your plan confirmed?

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Looks like her plan is confirmed (2/2010), and I'm unsure what Becky is wanting.

      Becky, if your plan is already confirmed, you may be hard pressed to go back and have it modified so that you can now contribute to a 401(k), even though it is allowed. The reference to 11 USC 521 is just that 401(k) plan contributions are "not" disposable income. However, you're now in a confirmed plan, so things are a little more... more... difficult to just change without a hearing.

      Yes, work with your attorney. It may "cost" you to modify your confirmed plan (additional attorney fees).

          If you can afford to contribute without jeopardizing your plan payment, go ahead. However, to go in amend your plan AFTER confirmation to include a 401K contribution, that will be a tough sell.
