    Amended return and Chapter 13

    I have recently filed Chapter 13. I filed my taxes and I will be receiving a return from Federal and I owe on State. Can I pay the State taxes with the refund I received from Federal? I think I am going to have to amend my federal return. Do I need to report this to the trustee?

    Was your expected refund listed on your Chap 13 petition as an asset and exempted? Was the amount you owe to the state listed as a debt?

      Since you recently filed and your financial estate falls under the control of your trustee, take this matter up with your attorney and follow his advice. Most people in a Chapter 13 have to provide copies of the annual federal and state tax returns to the trustee and if you proceed with what you want to do without checking with your attorney, it could create issues for your plan. Discuss with your attorney.
