    Vacating a jugdement

    Ive done a bit of research on the subject and have the basics down. I asked my attorney about representing me post discharge to vacate two judgements. She said that it is included in the bankruptcy and asked for the documentation on them. Can a judgement be vacated pre-discharge? Or did she misunderstand me and is going to do something else with the judgements?

    Nevermind. She basically told that I would have to do it myself post discharge. I guess that I will be researching how to file that motion myself until my discharge.

      you can do it yourself, however, you need to file a motion and then after the order is signed you must record it yourself.

      it's not difficult, however, even as a paralegal i hired someone else to do mine. many have done them themselves, i just wanted to make certain the process was completed correctly from start to end.

        Is it expensive? I would also be willing to pay to ensure it is done properly, start to finish. However, I would do it myself if attorney fees for it is really high. I have alot of other things going on so if I can pay an attorney $500 and save myself some time, I will.

          This is how I went about vacating my judgement - the hardest part was finding out the procedure to do it! Its for Minnesota but I assume your state would have similar info out there

            I really appreciate your help! Did you ever get the judgement removed from TU?

              Sent them a letter a week or so ago since they still hadn't removed it asking them to prove how they validated the judgement (following advice I got from another board). Since there is no way in heck that the court actually validated it, that would be a violation of validation procedures and I'm sure I can get it removed eventually.

                we paid abot $500 a piece from what recall and it was well worth it. again remember the order needs to be recorded and really that's why you want an atty to follow through with the process. otherwise the judgement even though vacated will be just sitting there as though it has not be removed.
