Divorce Delayed

I filed a Chapter 13 and the trustee/judge approved the plan with my own income/expenses since I have a pending divorce. It's been 3 months and no word from the divorce lawyer yet to finalize things.

What would happen if the trustee finds out that we are not divorced yet? Will my case get dismissed, or worse?

We intend on finalizing the divorce and are living separate, however I'm a bit concerned since it's taking so long for the divorce to happen.

I suspect what is important is that you are living separately, not whether or not the divorce is final.

Yes, we have been living separately for a while now. I'd just like to get this finalized so that everything is on the up and up.
